NYC set to ban trans fats Needless to say, restauranteurs everywhere are alarmed by this development. And many consumers see a big difference between NYC's highly touted smoking ban and the proposed fat ban. After all, as many have pointed out, smoking can harm everyone around you; eating fatty food harms only yourself. (Arguably, there's also an impact on society when you keel over from a heart attack and our tax dollars have to cover your medical expenses -- but that's a much more tenuous connection than the very real and demonstrable effects of second-hand smoke.) Consumers are also unlikely to be swayed by the comparison with New York's ground-breaking 1960 ban on lead paint, despite the similarities that the city's current health commissioner points out. In the end, the government can only go so far "in loco parentis" to protect us from ourselves. The Constitution may not say anything about freedom to clog your arteries, but it's definitely implied.
