The situation had its start in information about HP doings being leaked to the press. In an effort to determine who was telling what to whom, an investigation was launched. The problem was with the methods of investigation, some of which fell into a bit of a legal, and some would say moral, grey area. It turns out that, according to the BBC report, "investigators obtained the phone records and other data of journalists and HP employees without their permission."
Some shady methods seem to have been used to acquire the personal information, including what is commonly referred to as "pretexting" -- shady enough to catch the attention of the US Congress. That's because pretexting is a favored tool not only of the occasional private investigator, but also of those seeking to commit identity theft. HP may even face civil or criminal charges before all is done and over with in the matter.
