What the Cherokee Nation is pushing for and the South Carolina Supreme Court erroneously overlooked – is that any woman, of any heritage, who sleeps with any man of any apparent heritage – even a one night stand – CANNOT go ahead with an adoption without somehow ensuring that this man does not have a smidgen of tribal heritage.
WHAT does this kind of ruling do for the rights of women – of unwed mothers? What kinds of hoops will teenage girls now have to go through if the Supreme Court rules for the tribal governments? Where is the outrage from women’s groups over this case?
And yet – no one would say a thing of she opted to abort her baby instead. The tribal government wouldn’t – couldn’t stop her from doing that. Just consider the ramifications of a tribal government victory in this case.
Our Families are NOT Chattel for tribal governments – no matter how many claim them to be. As parents, we will continue to fight for full rights and freedom for our families – every one of whom is a United States Citizen – even if this Supreme Court makes the wrong decision.

From what my sources and I have been able to observe the highest priority of the state, the FBI, BIA as well as other federal agencies has been to silence us, to label us as liars, as incompetents not qualified to identify the abuse of a child, to minimize the seriousness of this situation with their fabricated, self-serving claims. Among these claims are, “It’s a new problemâ€; “This problem arose because the Tribe lost the person responsible for filing their formsâ€; “If those whistleblowers would shut up everything would be fineâ€; “Everything is fineâ€; “They are making great progressâ€; “You are expecting too much progress too quicklyâ€; “They are working hard.â€;“It’s all fixed.â€; “We’re doing a great job for kids†“You are not a subject matter expertâ€.

She said she was first given to a man at the age of ten. Her sisters were also given to men. She told how she begged to be allowed to return to the only family she had ever felt safe with – the foster family that the tribe, through ICWA, had taken her from. She told how she tried to run away over a dozen times – to get back to the foster home where she knew she was loved. She told how the home where the tribal govt placed her made her destroy pictures of the family she loved, and how they had cut a rope to save her when she had tried to hang herself. NO ONE else in America is put underneath a law that dictates how you are supposed to spiritually raise your kids. The 1st amendment says “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof”… but the ICWA Congress enacted comes dangerously close to doing just that.

While many tribal governments continue to fund congressional candidates who promise to increase tribal sovereignty, the voices of the children who are at the mercy of corrupt government continue to go unheard. The truth that must be revealed is that some tribal governments are not protecting the children in their “custody.†Some have said that there are children actually being traded and sold by the very people who are being paid to “foster†them. The Spirit Lake tribal government in North Dakota is not isolated in the mistreatment of children.

In the Thursday, October 18, 2012, segment of Dr. Phil show, Cherokee Nation Attorney Christi Nemmo refused to admit 2-year old Veronica had only a drop of Cherokee blood, but she also doesn’t deny it. She doesn’t answer the question because she knows people would be horrified. She tries to make the argument that it’s not about how a child looks or how much blood the child has, but that they have a right to be part of the Cherokee tribe.

What has to be acknowledged is that we live in a migratory, multi-cultural society. This means that many children who fall under the jurisdiction of the Indian Child Welfare Act have more than one heritage, and many times are predominantly of another heritage, and/or have family who not only haven’t any connection to the Indian Reservation, but have specifically chosen not to participate in the reservation system.

Now, I understand that Professor Gates had just returned from a long trip. I know that when I come home from a long trip, I am tired and crabby. It had to further aggravate him that when trying to get into his home to finally kick his shoes off and rest, the door was jammed. Topping off a long and tiring day, the police showed up and began questioning him. All he wanted to do was take a hot shower and go to bed, right? That’s all understandable. But none of it was Crowley’s fault and there is no indication that racial profiling occurred.
