Sisel International released a press release on 8 June 2007 in response to the lawsuit issued against them by Neways International.
Neways was sold to Golden Gate Capital in 2006 and since the acquisition, Golden Gate has sold off assets such as the corporate headquarters and manufacturing facilities in Utah. As with its acquisition of Herbalife, it seems Golden Gate are liquidating Neways in preparation of a sell off as a former shell of itself or to use the funds raised for other take-overs.
Sisel International is run by Darrick Mower and Tom Mower Junior, the sons of Tom and Dee Mower who were the founders of Neways International. It has a small range of nutritional products available but intends to bring to market a larger range of nutritional and personal health products that they claim will be the highest quality in terms of safety and effectiveness for consumers. It also claims to have a compensation plan that has ironed out all the foibles of other compensation plans currently available.
Neways International was the original company built by Tom Mower Senior and Dee Mower. It was sold to Golden Gate for an estimated $US700 million. As the Mower Mission was the core of building Neways, Sisel poses a threat to Neways because of the loyal distributor base following the Mower Mission and not the new Neways under Golden Gate’s control.
Tom Mower Junior stated “We will aggressively defend our right to provide the greatest products anywhere. We aren’t interested in taking cheap shots at our competitors.” This seems to be the Mower way, getting on with the job. Further Darrick Mower stated “We recognize this lawsuit for what it is: a transparent attempt to slow by litigation the progress of what could become the greatest network marketing company in history.”
Golden Gate had no comment preferring to let their lawyers do the talking in court.
Either way, the lawsuit is not good for millions of Neways distributors who remained loyal throughout the takeover. The whole company is reliant on the distributors continuing to sell products through their networks. These distributors are very loyal to harmful- ingredient-free products and now that the manufacturing facility has been sold, the integrity of the products themselves is in doubt.
Overall it looks as if Neways could be a house of cards ready to fall under Golden Gate’s management.

Hello Judith, Dee Mower will not be involved with the new company due to the divorce. Neways will continue to manufacture the products that were available at the time of takeover for now. New products are being released.
I feel I gave an unbiased report on the effect of the lawsuit and its potential damage to Neways. Everything in my post can be fact checked at any time.

In support of the facts, there is much to say about commitment and responsibility to a mission. Check the competitors out there. Sisel products are boasting paraben-free commitment. Check your products that you are purchasing elsewhere and see if that is the case.
Sisel products do not contain PEG’s while other companies are placing PEG’s in their hair re-growth conditioner and other hair care products (that are being promoted NOW!).
Sisel products do not contain Methylparaben or Butylene Glycol which is now found in the competitor’s product line. It looks like Golden Gate Capital is increasing capital by using cheap (harmful) ingredients that will prove to be the downfall of an empire of integrity.
Law suits are relative. Usually law suits are just a way for large corporations to protect themselves when they get pushed into a corner or to scream when the going gets tough.
I have nothing to say that is to mention the other companies name but most of you have done that for me. I trust you all have enough common sense to see what is going on.
By the way, Sisel is coming out with a full line of cosmetics. They will have the Sisel Safe emblem. Also women will enjoy using these cosmetics because they will not be out dated. Also women will enjoy the way the Sisel cosmetics apply.
Maybe the reason our competitors are so irresponsible with their product lines are because they are so busy looking at us.

Fiona Noah is right: If you’re smart, you won’t assume that something is true simply because it is published on the Internet. One Hour Expert’s comments are a good example of how somebody can sound like they know what they’re talking about, when in reality they’re just posting free-association ramblings based on wishful thinking or unfounded animosity.
The fact is, Golden Gate sold its interest in Herbalife at the time of the Neways purchase. But Golden Gate has not sold Neways’s corporate headquarters. Go see for yourself. Neways’s Corporate HQ is still there. So is its manufacturing facility–both still staffed by the same great employees who have helped to make it the powerhouse that it is. On the contrary, GoldenGate has invested in improving Neways’s facilities.
Things have been looking up for Neways since the Mower family finally cleared out if the picture. In fact, sales are so strong that Neways purchased a majority interest in Aseptic Solutions, a manufacturing company in southern California, in order to meet demand.
And yes, Anne G., Tom IS incarcerated, regardless of what other posters would have you believe. I guess Kathy Hassed is technically correct: Tom isn’t in jail–he is in a federal prison. And not as a result of this recent lawsuit, but because he was convicted of tax fraud (lying, cheating and stealing from American citizens). It will be interesting to see how much of his sentence he actually ends up serving, since his health is apparently very frail after he suffered a stroke some months ago. (Maybe it’s true that what goes around comes around.)
Not only that, but it seems that Sisel is having a ton of problems–with the suit filed by Neways for stealing distributor lists and product formulas being just one. It sounds like Sisel publicly denied the allegations, but under oath admitted wrongdoing, so the judge issued an injunction against Sisel and instructed them to return the stolen items.
Sisel has been ordered by a judge to stop soliciting Neways distributors. Makes you wonder: If they’re so great, why can’t they recruit on their own merits, without cannibalizing stolen distributor lists?
Part of the problem may stem from the fact that Sisel has not been able to produce a good product in its facility. I’ve heard that they even asked Aseptic Solutions (see Mark’s post above) to produce their product. Hilariously, the folks at Sisel are so out of touch that they had no idea that the company they were approaching was the same company that Neways had bought an interest in months earlier. Oh, those clever, clever Mowers!
Neways is a great company .The founders takes heart and soul to build it.
Why not create a blue ocean strategy where everybody wins.

I’m with Daniel. The Mowers built a great company from heart, soul, integrity, and a great mission. I joined Neways in the mid-90’s based on the quality of the products and the Mower mission. I had an opportunity to meet and speak with Tom early on and it strengthened my commitment to the products.
But in recent years I’ve had concerns about the quality of the products and this was not knowing all that was going on behind the scenes and apparently in public too. When I did learn about the sale of Neways, my first thought was I’ll never really trust the quality of the products again even if I continue using them.
Neways was never about the business for me - it was always about the products and the Mower mission. As long as I knew that Tom Mower and family were manufacturing the products, I felt good about using them. Now that I know that the control shifted several years ago, I understand where my sense of concern about the products came from. That gut feeling normally is right. I’m not saying the Neways products are of lesser quality today, but I can no longer say with confidence that I trust them either.
I just learned about Sisel yesterday and my thought was good for the Mowers. I wish the Mowers much success because they deserve it for all the good they brought to the products they distributed, to the people they helped along the way through the products and through the business opportunity, and to the industry as a whole. None of you would be where you are if it hadn’t been for the vision and mission that the Mowers created. Shame on Mark, Becki, and Toni for your ill thoughts. The three of you disgust me and perhaps that speaks volumes about the direction that Neways is heading with distributors like you involved. Not the kind of people I’d want to do business with. Good thing you’re not in my upline. Watch out - perhaps what comes around is heading your way.
As for tax issues - fraud or otherwise, I blame our lousy tax system, the IRS, and Congress for not overhauling the system long ago or for creating the problem to begin with. It is so convoluted and unconstitutional that it makes criminals out of the best of people. I say shame on the government over many decades for creating a monster that was never intended by our forefathers and shame on them today for using the tax system to hurt or manipulate for political gains. We need the FairTax - period - and a repeal of the laws that allow for the current system. So, I don’t care what they say the Mowers did or didn’t do regarding taxes - I blame the government.
Good luck to all the Neways distributors who really care about the company, the products, and the people they brought on board. Good luck to the Mowers and the new Sisel distributors for carrying on a noble and good mission that allows us an important choice in being proactive about our health. A bit of sad news. Ivy Johnson wife of Norma Johnson died the other day at his home. Anyone who knew/knows Ivy or Norma knows what a lose his absence creates. Together they touched alot of lives and made many friends within the Neways world.
Man, man, man, everywhere around the internet I read those missleading Sisel words, so many untruths… I recently joined Neways AFTER it was sold to Golden Gate. I have done my OWN research on Neways and Sisel and Neways wins without a doubt. I know what Golden Gate has done for Herbalife, and I see what they are doing NOW for Neways and for Neways distributors. Neways has the management AND the capital AND the products AND the contacts to create more fabulous products (do you know who is behind Golden Gate ?)…. You don’t have to listen to me, just do your own research.

In fact it is shame on you Carole for burying your head in the sand, plus you should look up the meaning of the word integrity, and then explain how it applies to Tom. I doubt Dee would use that word, and she knows him a lot better than you do.
LOL, somebody breaks the law and you blame the law?, that’s a laugh. The fact is that Tom and Dee were convicted of tax evasion and are serving sentences, paint it whatever color you like, that’s how it is. When greed takes over other things fall by the way, such as new products and continuing R&D. Are you really so naive to think that every product coming out of Neways was developed soley by Tom? . The situation with Golden Gate and Sisel regarding the alleged theft of the formulas and distributor lists, doesn’t surprise me. Tom has already shown us what sort of ethics he has.
Jack, your research is flawed because you try to use a fact to give an unspoken impression. The fact is that for a long, long time the manufacturing plant in NZ was underutilized, the fact is if it makes good business sense to consolidate manufacturing, then great, that’s what running a multi national business is all about. Your attempt to insinuate that the company is failing because of this is rather pitifull.

Golden Gate has no current interest in selling Neways – why would they? It’s no secret that their strategy is to keep on the current path of growth (which is phenomenal) and take the company public and make a lot of money. Are some of you unaware that Golden Gate is a capitalist company? It’s not like we’re living in Maoist China, here, folks. That’s what companies do: They purchase businesses that have managed to prosper (despite being run by, say, batshit-crazy feuding families), they enhance them, make them more efficient and smarter, and then they sell them for a profit. Regardless of the histrionic shrieking we hear from the peanut gallery, the only possible “victims” in this scenario are already in prison – and they are “victims” only of their own greed.
Take a look at Neways: Golden Gate is assembling a world-class management team, they just launched a new cosmetic line that’s too popular to keep in stock and sales are going up, up, up.
Now take a look at Sisel: The cheating old owner is in prison for tax evasion and conspiracy and–already!–they’re laying off workers.
Honestly, when I read some of these comments it’s as if we’ve flown back in time and I’m stuck in junior high school re-reading the first and last portions of Flowers for Algernon.
It’s truly amazing how rumors and false hopes are channeled through so many wonderful people. First I would like to say….. there are many awesome people who are and who have been associated with Neways for many years. Their dreams were to live a healthier and more prosperous life due to the unique product line of Neways.
However the current leadership of Neways has become very disappointing to many including myself. My wife and I (yes) were committed to the use of the Neways product line. It impressed us. My wife was a distributor. I never signed a Neways distributor agreement. Yet, through much effort, the Neways leadership and their corporate attorneys have attacked our family for more than a year now. Yes….I decided to become a part of the Mower Mission as the Mower family decided to establish the new Company SISEL International.
I can (first hand) vouch for the fact that Tom Mower Sr., Tom Mower Jr., and Darick Mower have sincerely created a product line that is nothing like what my family was using while my wife was a distributor with Neways. Although the products at Neways were great products…..our passion was our health, and the fact that the new products from SISEL were to be PARABEN FREE was a milestone of influence to our commitment to follow the Mower Mission at SISEL.
Although I truly respect the fact that we came to know the Mower Mission at Neways and met many wonderful people there, our time to move on had come. It has now been a year since Neways has our voluntarily resigning my wife’s Neways distributorship. We have been actively involved with SISEL and am thankful for the company’s immediate success.
I’ve read the rumors. I even read the recent scandalous message sent out by the leadership of Neways to all the distributors saying they have won their way in court against us and others. Neways Wins Court Victory Enjoining Sisel and Five of its Top Distributors
A federal court in Utah has issued an injunction against Sisel International, LLC and five of Sisel’s top distributors in Japan. Among other things, the injunction requires Sisel and these distributors to return all of Neways’ distributor information in their possession and prohibits Sisel and its distributors from using such information. In addition, the Court found that Sisel’s top three distributors—Koji Yamamoto, Fumiko Matsumoto and Toru Egashira—likely have breached their contracts with Neways by recruiting Neways distributors to join Sisel, and are now prohibited from continuing to recruit Neways distributors for a period of one year from each distributor’s date of suspension from Neways.
In its 23–page ruling issued February 11, 2008, the Court ordered Sisel, Mr. Yamamoto, Ms. Matsumoto, Mr. Egashira, Kaoru Kitagawa, and Chiharu Hayashi to thoroughly search for and return all information relating to Neways’ distributors and prohibited them from using such information in the future.
The victory was a significant one for Neways, and came after a two-week evidentiary hearing in federal court. Neways alleged that Sisel and its Japanese distributors were misappropriating Neways’ confidential and trade secret information regarding Neways’ distributor network, and that the Japanese distributors were breaching their contracts with Neways by soliciting Neways distributors to join Sisel. After hearing all of the evidence, including testimony by the Japanese distributors themselves, the Court found that Neways was likely to prevail on these claims and that the defendants should be enjoined.
This is the third time in less than a year that Neways has prevailed against Sisel or one of Sisel’s distributors. In May 2007, the same federal court ordered Sisel, its owner Thomas Mower, Sr., and several of its employees to return all copies of Neways’ product formulas, vendor lists, and distributor lists, and prohibited them from continuing to use that information. Two months later, a Utah state court entered an order against Sisel distributors Jef and Patricia Welch restraining them from recruiting any present Neways distributor to participate in another multi-level marketing company. As a result of the federal court’s recent ruling, a similar restraint is now in place against Mr. Yamomoto, Ms. Matsumoto, and Mr. Egashira.
“Neways is extremely pleased with the Court’s ruling,” said Eric Larsen, Neways’ C.E.O. “In enjoining Sisel and its top Japanese distributors, the Court has affirmed what Neways has always believed—that companies are free to compete in this market, but they must do so fairly and honestly. We hope that is what we will see in the future.”
Chris Crump, Neways’ General Counsel, said a significant part of the case against Sisel has been about protecting Neways’ distributors and confidential distributor information. “Two courts have now recognized the importance of those protections,” said Crump, “and Neways will continue to take all necessary steps to ensure that our distributors’ businesses are protected.”
The case will now proceed on Neways’ other claims against Sisel, Mr. Mower, and the other defendants. These claims include allegations that Mr. Mower breached his fiduciary duties to Neways, that Sisel’s products are the result of unlawful theft by Sisel of Neways’ trade secrets, and that Mr. Mower and a number of other Sisel employees have intentionally destroyed evidence to prevent it from being discovered in the case.
I have been waiting for someone else to address the slanted journalism being fabricated by Neways. My brother happens to be on the team of attorneys who worked countless hours to represent SISEL and was overjoyed with the Judge’s ruling! It was a major victory in what is truly a David verses Goliath situation, with Neways bringing in a huge team of attorneys from San Francisco AND hiring a large firm from here in Utah. Neways was asking that all SISEL distributors be blocked from recruiting distributors from Neways and that 6 big SISEL distributors in Japan be prevented from recruiting indefinitely. The ruling clearly stated that SISEL distributors can freely recruit distributors from any company, including Neways. In terms of the “Big 6″ distibutors, 3 were completed dropped and allowed to recruit immediately, 1 was prohibited from recruiting Neways distributors for approximately 2 weeks and the other 2 were enjoined until May (about 3 months each).
Imagine my surprise to read outrageous Headlines like “Neways Wins Lawuit”!
Some articles quote Chris Crump (Neways attorney) as saying the injunctions put on Neways by the government aren’t really that big of deal. It doesn’t take much smart math to figure out that 3 months of injunctions for 500,000 distributors is much more catastrophic to Neways than Judge Jenkin’s decision is for SISEL.
Additionally, my husband just happened to be in Japan when the story about Neways broke. On the national news, it repeatedly ran as the #2 story in the country at least 3 times the first night(12 -15 minutes each time) and again the next day. Having a son who attended College in Tokyo, my family has many friends in Japan who are in the MLM industry, working for several different companies. The general consensus conveyed to my husband by these friends is that this action by the Japanese Government is a “momentum killer” and may be the end of Neways in Japan, which is 85% of their business.
To add to the catastrophe for Neways, is that the National Convention in Japan is to take place at the Tokyo Dome in April and the contract for this venue may be terminated because they have a track record and the legal right to prohibit any “black listed” company from renting. Even if the event does take place, it seems hard to imagine an enthusiastic atmosphere in the midst of this government sanction. Far worse for Chris Crump and associates is that Neways is going to be going public in the very near future and their value has just hit the basement and will continue to fall because of the very “unfair and illegal practices” that CEO Eric Larsen has repeatedly accused SISEL of practicing and has self-righteously claimed his company will not condone. I call this whole situation Karma and see it as Neways getting what it deserves!
I am very disappointed to read all this here.. I came up with the beginings of Neways in 1995.. It changed my life and the thought of it are great memories..
The Mowers gave us that and they gave us Neways..
I used Neways exclusively for 13 years.. The change in some of the ingredients and the management has caused me to lose full trust in it.. and now this paraben thing and them having Butlyne glycol and such in the products worries me..
I Just read the Email I got from Neways announcing thier win against sizzle and charges against Mower.. I was surprised I knew nothing about it..
We’ll see what sizzle comes up with but if the prices aren’t lower I won’t be able to afford them.. Neways hasn’t been the same for some time.. ever since they came out with that new catalog and ditched all the scientific stuff I kinda got dissapointed.. and the prices are just too high..

I Never really made any money in Neways up to like 200 in a month once.. it was about the products and the mission story.. I talk about Fluoride every day and I thank Neways for educating me about it..

I am not saying I am for or against neways or sisel. But I was lied to when I was signed up,in 2006 with neways and told it was a family run company. I think I will just have to get my head out of the sand and realise that any business that is american based, is just in it for the money. I have experienced dishonesty from neways and can imagine I would be lied to with sisel as well.

I have had 9 wonderful years with Neways, but googling Tom Mower and learning of his new company SISEL, I joined immediately, in August 2007. I have had nothing but support from Teamsizzle members.

I have recently heard of a video being used by SISEL in their compliance training. One of my friends in Japan told me that the main points being emphasized are: 1)SISEL does not say bad things about its competitors 2)SISEL does not point out questionable ingredients in other products 3)SISEL does not make any medical claims that its products can cure specific diseases.(following FDA guidelines in this regard) What SISEL can do is 1)Explain what the Mower Mission means (to bring health, happiness and prosperity to people around the world by creating safe and effective products)2)Allow people to try these wonderful products 3)Answer questions they may have about the company and 4)let them decide for themselves if they want to become a part of this quickly growing SISEL Team. Makes great sense to me!

When one of you negative people can prove that you are capable of running a multi million dollar supplement company and not have problems then your opinion can be respected! Think of like this…. Can you control your kids 24/7? Now try and control 500,000+ distributors and management! Why in the Hell would Tom try and hide 1,2 or even 10 million dollars from the IRS??? It may be of note to the commentators that as of 5th August 2008 Sisel has defeated all lawsuits brought against them by Neways and are moving ahead.
Neways has sold its corporate headquarters and is now renting it back and its manufacturing facilities.
I’m not sure which will end up being the house of cards, but I do know this, this is a forum for debate and information, not an avenue for personal attack. Let’s keep it relevant and informative.

COURT RULES THAT JAPANESE DISTRIBUTORS DID NOT MISUSE TRADE SECRET INFORMATION
Salem, Utah, August 5, 2008—In May 2007, in an effort to prevent SISEL International (SISEL) from recruiting Neways distributors and from otherwise fairly competing in Japan, Neways filed a lawsuit against SISEL and some of its Japanese distributors. Yesterday, the United States District Court in Utah granted SISEL’s motion to dismiss Neways’ claims of misappropriation of trade secrets against the Japanese distributors.
Neways has maintained that the bonus recaps mailed to these Japanese distributors were trade secrets that had been misused to recruit distributors to SISEL. SISEL filed a motion for summary judgment on this issue arguing that Neways had no evidence to support this accusation. At the hearing, the district court judge ruled that Neways had failed to show any evidence to support the claim of misuse of trade secret information by the Japanese distributors. Other claims remain outstanding.
“We at SISEL are gratified the court has seen that Neways had no facts to support their claim of trade secret violations by our Japanese distributors” said Tom Mower, Jr., Chief Executive Officer of SISEL. “We believe the other claims filed by Neways will meet a similar fate. We have always viewed the Neways lawsuit as an attempt to use the U.S. legal system to cut off SISEL’s ability to compete fairly with Neways in Japan.” He continued, “We encourage our distributors everywhere to comply with the policies of our business and to honor the contractual commitments they have with other companies.”
SISEL views the court’s ruling as another victory in the litigation initiated by Neways. Tom Mower, Jr., noted again that SISEL’s tremendous success will continue. “This will be true,” he emphasized, “especially when the people of Japan look past Neways’ litigation tactics and actually consider SISEL’s products and programs. SISEL’s success in Japan and worldwide will only continue due to its superior personal care and nutritional products, strong compensation plan and its outstanding family of distributors.”

I was a Neways distributor for 4 years. Good thing I loved the products, because I never built a downline, never made a dime. Figured it was time to pursue another opportunity, and found SISEL. The Mower name was the deciding factor.
All rumors/factoids/personal grievances/emotional outbursts aside, the Mower Mission is alive and well, despite Neways’ efforts.
My business is growing, thanks to the support and guidance of my upline. They don’t rely on “ooh rah you can do this” to inspire their distributors, but on solid business principles backed by a company that knows where its success comes from.
One thought…if Golden Gate takes Neways public, investors and their profit will become the overriding concern. Which means retail marketing for increased sales. What happenes to independent distributors then?
Neways cannot sell until the lawsuit is settled, because no one wants to buy a company that is in litigation, Golden Gate wants to take it public to get their money back, they care about nothing else.
Contrary to speculation,Sisel is not having any problems and is growing at a tremendous rate, coming out with more powerful products than Mr. Mower created for Neways, Mr Mower was the brains behind Neways and their products, and with the latest research and technology, has some of the very latest state of the art products available and coming out with many more weekly.
Vincent, what has Golden Gate done for Neways, except take out some of the good ingredients, sold off the buildings, recentely fired the CEO Eric Larsen, layed off a lot of people, I don’t think you have the inside tract to know what is going on, because we that have friends that work there know a little more of what is really going on.

The lawsuit is settled, so now Golden Gate will be able to sell off the company as they have been trying to do, but due to lawsuit, no one wanted to buy. It will be interesting to see what happens now
