Faye to face criminal  CJ Savage reviewing Jammeh takes over case!

The Gambian authorities are not treating Omar Faye’s wife snatching case lightly. Momodou Lamin Kah, the cadi, who was said to have tied the knot between the Religious Affairs Minister and one Ndey Njie whilst Ndey’s first marriage wasn’t dissolved, has been summoned to the police in Banjul and is  reportedly reporting on bail. Cadi Kah is in trouble for faking the marriage certificate , which is currently a subject of high police probe. Sources said Kah is, at present, reporting to the police headquarters, pending a signal from the head of state as to what line of action he would take. If the police finish with their investigations, both Cadi Kah, Omar Faye and Ndey Njie are likely to face conspiracy and forgery charges to commit felony. The high profile case has taken a dramatic twist with the police digging into the Faye, Kah and Njie’s conspiracy theories to fake a matrimonial relationship, which was reached under questionable circumstances, police said Wenesday. Police sources said the Cadi must have been bribed by the new couples to fake the said marriage. Ndey Njie was married prior to abandoning her husband Omar Adams. There is no records available before the Gambian courts to suggest that the two had legally went through a divorce proceedings to end the said marriage. Gambian police detectives are gathering bid and pieces to indict Cadi Kah and all those associated with the said material fraud ever involving a Gambian Minister.

The president’s intervention was expected earlier last week but thanks to his visits to Cuba and Venezuela, the matter was stalled but a presidential action is anticipated in weeks or even days to come, sources close to the Presidency have hinted. A certificate shown to our Banjul chief Correspondent indicated that Ndey Njie’s marriage to Sheikh Omar Faye was necessitated by the divorce of Njie and Omar Adams. But it was discovered that this certificate, which was endorsed by a commissioner of oath, was in fact falsified. While Minister Faye is being increasingly sidelined by the President following his “unprofessional conduct” reports have it that the Minister uses his powers to lure the Cadi  and local court staff to issue the said marriage certificate which was obtained under false pretense. The Cadi who allegedly receives few hundreds of dalasis for running such errands for the Minister has told the police that  he was not aware that Madam Njie was still marriage Adams prior to signing of the said marriage certificate.

Minister Faye who was on self imposed exiled in the US is currently married with three wives. His relationship with the President is strained as we go to press. The Gambian leader was reported to have been shocked by Faye’s misconduct. No one seems to know what would come out from the said case. It’s now a subject of police probe. Reports even have it that Omar Faye was called in for questioning with regards to the said case. If it is established that these people faked the marriage certificate, they are likely to face between six and three years jail term if convicted. Forging an official document is considered as felony under the Gambian laws.

Following the commencement of the case,  the Freedom Newspaper earlier reported that the marriage certificate was forged. This paper also reported about the institutionalized corruption in the Gambia’s judicial system.

A top legal luminary told us that one don’t need to be married to obtained a marriage certificate in the Gambia, while citing corruption in the judiciary. The legal mind said due to poor pay and low staff morale court staff resorts to accepting bribes from people looking for marriage certificates and other court documents. The lawyer cited a court staff who was jailed for three years sometime ago for falsifying  marriage certificates for Gambians within and outside the country.

This case has civil and criminal angle. The plaintiff Omar Adams has instituted a court action against his former wife for allegedly transferring his house papers in the name of  her daughter without he Adam’s expressed permission. The property in questions is valued at D3Million Dalasis. Adams wants the court to issue a declaration to nullify the transfer of property title deed that was effected. Judicial staff who effected the paper work for the transfer of Adam’s property are likely to be in trouble. Chief Justice AK Savage was assigned to review the case to determine the legality of the said property transfer.

Represented by Lawyer Ida Drammeh, Adams accuses the Minister of hijacking his matrimonial home and also luring his wife into clandestine activities to transfer his property title deed.

Minister Omar faye is facing  his worse night mares these days. Faced by insecurity about the continuity of his employment, Faye is also struggling with a looming collapsed marriage at this hour. If the Gambian courts established that he faked the said marriage, the Minister is likely to run into troubles with other wives one of whom according to sources is threatening at this hour to divorce the disgraced Minister.

Sources close to the police said the case in question was not being treated lightly. They cited the criminal element associated with the matter. Out of the people interviewed by police,  no one  had so far testified that there was as any divorce between Ndey Njie and Omar Adams.  Cadi Kah is at this hour helping the Gambian police with regards to the said marital  fraud.
