The deportation of a very good Gambian writer to a very hostile reception of the
Jammeh terror squad, is what i called an ungreatly behaviour of great noblemen? This is a behaviour which should shame the British gentry. For this land has been abusing the word ‘Great’ by making it a prefix of a very bad country (Great Britain).
This land had made many mistakes in the past, which one would have thought it had learned from its misdemeanors. In the early 19 century, when Hitler
and the Nazi Germany started their persecution of the German Jews, many of the Jews tried to flee the persecution to other european countries, Britain was one of them. The ungreatly British xenophobic of such an influx of refugees, led to their refusal of entry to those Jews from escaping to Britain, however, due to such an ungreatly act six million Jews were later executed at the Nazi concentration Camps.

To clean this guilty conscience for not acting right and quickly enough to prevent the Jews execution, the British joined the negotiation table with other nations to bring about the 1951 Geneva convention on Human Rights, which guarantees a safe heaven in another country, for any one who is in fear of persecution from their native country, for reasons of their belief, political affiliation, religion, ethnicity, etc.

This was the convention that Britain singed to in 1951, however, of lately it is no longer the act that this noble country abides by. The Nationality, Immigration and Assylum Act 2002, made some far reaching encroachment to Britain’s obligations under Human Rights conventions.

They deny people the right under the 1951 convention to seek assylum in the UK, simply because they are regarded as late to make a claim. So that for a person to qualify for assylum in UK, under this Act, they have to seek assylum at their point of entry rather than wait after entry to seek it!

This is very inhumane, how can one expect a person to seek assylum without prima facie seeking legal advice. Yet the law makers, blatantly passed such a draconian law, even though it was clear to them that there are no Solicitor firms or Barrister’s chambers at the airports or sea ports.

The 2002 act, which is the current Immigration law in this country is a farce, this is no law, like the famous slogan of John Finnis stated “lex iniusta non est lex“; (An unjust law is not a law).

When one looks at the characteristics of good law in legal jurisprudence, you will find that a good law is a law that is unversal in its applicability. Laws that disciminate foreigners from the citzens cannot be a good law. No good law should support discrimination, not even based on nationality. Yet this land of great scholars is flaunting this basic ideals of a good law. One wonders how can its politicians criticised the laws of other lands.

Talking of the 2002 Nationality, Immigration and Assylum Act, that is a piece of cake compared to the one coming into force later this year, The Nationality, Immigration and Assylum Act 2006. This will put a full stop non assylum to certain countries. In simple literature, there is going to be a country list system, countries that are included in the qualified category for assylum; citzens from those countires will be allowed to seek assylum in the UK. Those that are not included will be automatically disqualified and even if you are Pa Nderry from those countries, you will be rejected for assylum in the UK.

This is Britain’s final throw of the dice, it is now opting out of its noble venture! I guess the Great Britain is no longer Great after all!
