Pfc. John Jodka, 20, Cpl. Marshall Magincalda, 23, and Lance Cpl. Jerry Shumate, 21, were among four other Marines and one Navy corpsman involved in the kidnapping and murder of a 52 year-old Iraqi man.

Hashim Ibrahim Awad resided in the town Hamdania. The serviceman broke into the man’s home, bound his feet, and dragged him from his home to a roadside hole where they shot him to death. The three face charges of conspiracy, housebreaking, improper seizure, holding a victim against his will, and murder charges. Fortunately, the soldiers will not face the death penalty. The other five servicemen will have their preliminary hearings in the weeks to follow.
