For the last few months, the DIT has been engulfed with the 2G scam issue andÂ regular work in the department seemed to have stopped.Â For the last few days the familiar face of Mr Kapil Sibal the chief advisor of UPA in Lokpal matters is missing fromÂ public gaze. Perhaps he has withdrawn from the scene and passed the baton to persons like Renuka Choudhary to carry on the Anna bashing mission.
There is one good thing about this development. At least now we hope Mr SibalÂ will beÂ attending office and clearing files which are perhaps piling up in his ministry.
We had pointed out several times through the Internet media and through direct letters/emails that the DIT had failed in its duty to appoint a Chair person for the Cyber Appellate Tribunal (CAT) and as a result several Cyber Crime victims are put to an avoidable inconvenience.
The fault appear to lie squarely with the inability of the department to take decision in time to find a replacement for the previous chairman who retired on 30th June 2011.
In particular the Ministers in charge of the department namely Mr Kapil Sibal, Milind DeoraÂ and Sachin Pilot are resposnible for this impasse.
Sadly there appears to be no system which monitors the virtual closure of CAT since June 30, 2011. The letters sent by me to the President, the Prime Minister, the Law MinistryÂ as well as the Chief Justice of India appears to have gone unnoticed.
This reflects very badly on the state of affairs in Cyber Judiciary in India and its administration by the DIT.
Can anybody in DIT clarify why they have not been able to find a suitable person to the post even after so many days? If really there is a dearth of competent persons in the country, why did DIT not consider giving an extension to the previous Chair person by making whatever administrative changes that were necessary?
We often complain about delays in court proceedings for various reasons. But delays occurring solely due to the inefficiency of the administrators is unpardonable.
Hope that with Mr Sibal being releaved of the Lok Pal resposnibilities he will attend to reactivate the paralysed DIT.
