On Thursday we found ourselves dealing with a 10 minute hearing. Jose Baez was missing, one can only assume that Jose had bigger fish to fry, or, his dry cleaners were holding his suits as ransom for unpaid bills? I don’t know, so don’t jump down my throat!
The Thursday hearing however seemed like the summer of ’67 love fest. I was almost expecting prosecutor Jeff Ashton and defense council Cheney Mason to put on Tie-dye shirts, flip flops, headbands, and head off to smoke a joint in the nearest VW-Bus!
Friday saw a very different situation.
What was supposed to be a continuation of the ‘Frye Hearing’ moved into many other areas. Both Prosecution’s Ashton and the always interesting defense lead Jose Baez got a wonderfully constructed verbal beating by Judge Perry on Friday. Perry had clearly had enough of them performing like naughty children, and in announcing the break for lunch suggested:
I would stop by my favorite ATM machine because if I… I have told you in the rooms around you, descriptive adjectives such as you used some of the content both of you have exhibited …
The bottom line was that Judge Perry had enough of the bickering. The deal going forward was that the ‘guilty party’ had the option of voluntarily handing $100 cash over for each transgression, the money would be given to the United Way. The other choice was the option of being found in Contempt of the court, a black mark on the persons permanent record, and the same $100 being spent.
Clearly the message was received by both Baez and Ashton. They were for the most part much better behaved after the lunch break.

ashortcoldwinter, I’m sorry but I could not do that. This will be my last post here as I don’t wish to make trouble, but I did want to tell you that I am not the person that you mention above. I will stand by what I say and it’s not nice that someone else gets the blame for my words. I don’t know how I can convince you except to tell you I am a woman, I’m 55 yrs old and I am Australian living in Australia, look at my user name does that make sense.
Thank you for your suggestion and it IS a good one but I believe when you get to my age you should not torture yourself with things or people that upset you, life is for living and enjoying and the world is not going to end for me if I dont come back here. And no one here will have to listen to my whingeing, of which I have done on 3 occasions. Cheers.
I don’t think Marinade Dave is any type of torture. Least the man gives of himself to report the goings on of an otherwise bizzare murder case.
Thank you, sorry, but you keep bringing him up, so I believe he is the one who upsets you, so as you say you should not torture yourself with things or people who upset you. I suggest you bring some cheese along with your whine if there is a next time. Dave has a lot of fans. And that’s the way it is.

I am having trouble creating an account; but want to agree with Peter that Ashton has about had it with the antics of this defense team. I have also noticed that he has little patience for defense witnesses that are less than forthright and no less than evasive.
In fairness to all, Jeff Ashton need to consider temper management.
José Baez sees Ashton’s vulnerability- temper, and antagonizes him with his smirks and strutting around the podium like a peacock. When you cannot perform good lawyering, you tend to resort to schoolyard tactics. This appears to be the case with Baez.
Here is an example- Baez questioned the missing person investigator who, accompanied by Geo Anthony, picked up that trash bag, at Johnson’s Towing. Baez figured he could score a point by trying to convince the court that the bag of garbage was stinking up the bay area. Ashton, on cross examination, asked the witness, if the Pontiac was already in the bay area when she opened the door. Ashton proceeded to show the stench in the bay area came from the car and not the garbage.
This is what makes Baez frustrated. It is like he gets almost to the top of the totem pole and Ashton yanks him back down to earth.

Throughout the next few months we’ll see both the defense and the prosecution gain and lose ground, over and over again. At times it’s bound to be maddening!
I’m stocking up on marshmallows now to hurl at the computer monitor. It’s better than shouting expletives into a pillow when minor children are around.
Mikal, I think that the marshmellows would get eaten before they hit my monitor but I know where you’re coming from. I ended up with a headache after Friday’s hearing. Baez is so slow when he questions the experts and has to get the last several words in. Baez can be insulting. For eg: He asked the K9 handler, where did he get the ‘bright’ idea to keep a log? On Friday, he called the chloroform ‘crazy.’ I don’t know how Mason can just sit and watch Baez’ performance. Maybe Cheney turns his hearing aid off.
Another excellent broadcast. Hopefully I be able to listen live next time. Missed it again. I agree with Cobra’s take on how the Defense could argue that Caylee’s death was an accident and Casey was so afraid of George and Cindy that she panicked. However, there are problems with this story in that why was there duct tape placed across Caylee’s face? Also, the State was very careful in the charges they bought against Casey. I believe Casey is still being charged with Child Neglect. So, if she gets off on murder she will definitely be found guilty of that count because her neglect caused the death of a child. This will still mean a lengthy sentence.
It’s obvious that Casey is very emotionally attached to Jose.
I also believe that Judge Perry sees through all of them. He is going to do everything in his power to ensure that Caylee receives justice. This may mean that he will not allow Dr Vass’s evidence in because the science is too new. I do believe he will allow the hair in and the cadaver dog hits in.
