Gosh that article was SO poorly written. I think it’s based on NeJame’s motion in which he quoted Mason saying to the media not long ago that the area where Caylee’s remains were found were “impassable.”

Which is exactly what TES has been saying all along. And which also negates any reason for the defense to have TES’s records! LOL!

Bozo is probably chewing out Mason as we write!
ROFLMAO! But I’ll bet Bozo will try to backpeddle and “re-write” history and pretend Mason meant something else.

Alex, I think the problem is that you disagree with Judge Strickland’s rulings and you are blaming NeJame for it.

You think JS should have let Bozo have copies of all the files and personal info of all 4,000 searchers – or be able to copy it down somehow. JS did not think that was warranted. He allowed Bozo access to PERTINENT information. If there were any disagreements MN and Bozo, JS would have decided on them.

Nejame acted in “good faith” meaning he acted according to the law and in compliance with the Judge’s order. Bozo did not.

Hi m2c- I found the information you cited & more on WFTV, we will have to agree to disagree about whether or not Mark NeJame acted in bad faith as to allowing the defense access to the TES Records. I would have expected that someone under the auspicious of the court would have overseen the Review, not a volunteer, Bill Fitzgerald, from TES, this is my opinion is a conflict of interest. However Mason & Baez did plop down the $12 for an hour of review, and for whatever reason, another appointment for Baez, who knows with Mason the review was not completed. Again my opinion is that the Defense should have beeb able to review & copy records from the beginning any information that they then deemed material should have gone to the judge in camera for review as to whether it would be admissible or sealed!
I do enjoy the spirited debate with you, but want you to know that I in no way feel that Casey is innocent but she does deserve a fair trial. As in many cases it is suppose to be innocent until (I prefer unless as until implies it’s just a matter of time) proven guilty but most times an innocent person must prove themselves innocent or at least not guilty. So much is stacked up against a defendant but I do like the Sunshine Laws where there is reciprocal discovery as it gives both sides a chance to show their side of the argument in a fair and prepared way. It allows a defendant to spend money wisely on pertinent investigations rather then waste it on wild goose chases. Here though I think the defense if not reined in would spend money on wild goose chases to the detriment of the taxpayers of Florida. However it appears our argument is mute as the Defense isbacking away from the TES Records. Wonder if they found another sucker to pin this on. Perhaps Lee as his court appearance was eerie!

Very good m2c, I remember Boez tried to send a third party in to copy all that stuff. Usuallly files, called discovery, have to be shared between both counsels before start of trial. This does not include hiring outside parties to be privvy to those files. Doesnt Boez have a secretary or a paralegal in his office?
When hasnt Boez been obnoxious? From Day one, he has been acting like his azz is up in the air, he has made statements that he has never followed through on, he has been rude to certain media reporters. If Casey was so innocent as he had claimed, he would not have had to go before the media to say that, he had to back up with proof to the courts, he could have had a special emergency meeting, but that never happened either, instead he is going to let the case go on although he has all this proof, Well, Boez, show it now or forever hold your peace.

What NeJame was upset about was that when Strickland gave the defense the ability to read and flag all the files:
1) Bozo tried to send a third party copier company to make copies of all 4,000 files. That was NOT what Judge Strickland allowed.
2) When that failed, Bozo never reviewed any files and did not pick up the 32 files NeJame had for him – of people who really were in the vicinity of where the remains were found (and said it was flooded and impassable). NeJame had those 32 files couriered to Bozo.
3) Bozo made false claims about those files and others (Joe Jordan and Laura Buchanan).
4) Bozo (with Mason) made his first visit to see the files very recently and were obnoxious – and still didn’t review all the files.
NeJame NEVER acted in bad faith. He acted in accordance with the judge’s orders every time. The defense did not. That is bad faith on their part.

Hi, Alex @ 7:35 pm – I finally found NeJame’s Bad Faith motion which has a lot of the history of this situation. It was Judge Strickland who originally gave Bozo the ability to flag files of interest – long ago – and get a copy of those files. IF NeJame had a problem with some of the files, then the judge would review it in private. That’s the way it’s been since the beginning.

I’ll post the link in my next comment.
Quoting an excerpt from the Bad Faith Motion:

“10. On April, 5,2010, the Defendant, through her counsel and TES, through its counsel were heard on the Motion to Modify the Court’s Order. The Honorable Stan Strickland entered an Order denying the Defendant’s Motion to Modify the Court’s Order on Defendant’s Application for Subpoena Duces Tecum for Documents in the Possession of Texas Equusearch. The Order states in pertinent part: Having now reviewed all of the exhibits submitted, this court sees no reason to modify its original Order of August 27, 2009. The files are still available for review at the office of Mr. NeJame, and, IF FLAGGED FOR REVIEW and no agreement can be reached, this Court remains able to schedule an in camera review followed by a ruling.”

It was also stated that both the state (LDB) and Brad Conway had reviewed all the TES files long ago, they had tagged some and NeJame had given them the files they wanted.

When Bozo and Mason made their recent, short and FIRST (partial) review, NeJame gave them the files they flagged, too.

Of course the files they asked for were for people who had been three football fields away from the site where the remains were found.

Why is the defense acting this way? Because all the defense ever wanted was to manufacture reasonable doubt and have the ability to harass searchers who had nothing to do with the area Caylee’s remains were found. And to trash and possibly destroy TES.

Cindy is jumping through hoops trying to “show” Casey that she “has her back NOW,” and that is why she is still lying up the yin yang. It’s occured to me that if Cindy said (putting words in her mouth) “You know what? We had a screaming fight beforehand. I threatened to take and adopt her child. It pushed her over the line. I feel so guilty in 1001 ways, you can’t even imagine. My conscience can’t comprehend her behavior, but I believe quite strongly that I unknowingly contributed to her breakdown.”

Does anyone think that speaking from the heart like that might have swayed some potential jurors just a little bit? I know I would have respected both Anthonys if they had spoken compassionately and sincerely, as George did in the beginning, and pleaded for Casey on the basis of acknowledging Cindy’s hand in the ensuing events (Casey is ultimately completely responsible for her daughter’s death, but perhaps more honest comments like this would have provided some mitigating circumstances.)

Alex, it’s a shame that Mallory is still with Lee, partaking of the familial Kool-Aid. Lee is a bratty, smug, and self satisfied poor excuse of a human being. I agree that no one has Caylee’s back. Her death seems to be as insignificant as a smushed bug on the sidewalk.

At first Cindy cried that Casey stole great sums of money off her, eventhough she didnt scream about it until Caylee went ‘missing’; George backed up that claim, but then they turn around and George was supporting her commissary account, not by $25, or $50 amounts, but by $100 amounts. Go figure! People who say they have no money just dont do that.
I think after all this time, somebody in Camp Boez had to have read a lot of the documents, no excuse. I cant wait to see how many Motions in Limmine get filed just before trial starts. Going to be a mess.

Alex, I think the state would feel obliged to look at the letters in case there was something there pertinent to the case. They can’t be blamed for that. And it isn’t their fault there are so many of them. I don’t know if the state will use anything in them or not but they are obliged to turn them over to the defense and did. So I don’t see how any fault can be placed with the state for that.

As far as the note-taking on the TES docs. The defense has always been able to read every single file AND tab or sticky or somehow request any file they wanted. So why the “need” to take notes “willy-nilly” so to speak? I don’t see that.

I think the state and both judges have bent over backwards to be more than fair to the defense and avoid appeal issues. But some times the defense is over the top. They can’t just get every single thing they want the WAY they want it. imo

Doesn’t matter. So far this time they can take notes. We’ll have to see what happens as a result of Nejame’s bad faith motion.

m2c, exactly, the state is not using those letters and don’t need them but if you think that those letters weren’t read by the state I would say you are surely mistaken. I can’t believe that anyone would think that they can do an investigation and not be permitted to take notes, retain that information and accurately complete their investigation without documentation.
You may not be aware but on this website there have been posters who have gotten upset when someone can’t remember where they read or heard something. This is nothing compared to a court case in a life or death situation!

Alex, about the letters. Bozo was complaining that the state had not released everything they had, so Judge Perry told the state to go look for anything and everything and release it. They did. Hence the letters. I really doubt the state will be using them in their case. They don’t need them. But they’re available to the public, may have been reviewed by the state, and so the state released them. If they had not released them Bozo would complain about that. Now, of course, as with most everything he whined about getting – and got – he can’t be bothered to read them and is apparently using them to try to get a delay in the deadlines and probably the trial. What a sleaze.

Madhatter- The State and Brad Conway don’t need to look for exculpatory evidence, it’s a joke that they even went, they didn’t need to take notes because there was nothing there to help their cases and they knew it! The defense on the other hand IS looking for exculpatory evidence and wheter it is there or not they have the right to take note of anything they deem may be exculpatory.
What is the State’s need of the letters from admirers of Casey? Totally useless but they still looked, they still copied and they still released it for us to view. I see no difference for the defense! I don’t think it will help their case but it is one less appeal for Casey!

Why would Jose and Cheney need to take notes of the TES records?

The order was to review the documents and if they found anyone they felt was in any way connected to the discovery site, to request that person’s file. NeJame’s office was ready to make a determination then and there if that record would turned over or if there was a problem, to take it back to the judge for final decision. If no problem, then an instant copy for the defense of the record in question – on which they could note to their heart’s content.

This is exactly the same restriction by which the state and Brad Conway worked and neither had a problem with it, even though each spent multiple hours pouring through the records.

The bottom line is there is no information there for the defense, there has never been any exculpatory evidence there, the entire proceeding is an exercise in drama for the sole purpose of delaying the trial. Cheney and Jose chose to make a mockery of the judge’s order, even though it was given twice, to insult and ridicule Mark Nejame and his staff, to invite the media to publicize their dramatics, and to smear the name of TES – an organization which has dedicated itself to helping those in need.

Untimately, this is the same defense strategy they are using for all the evidence, as seen in the debacle over the CD’s of tips. Jose cries he doesn’t have them, then cries they only turned over the psychic tips. Of course, as they could only turn over tips for which the investigation was closed, which at the time was the bogus psychic tips, especially since Jose was crying the police were not following up on tips. Then, once the other tips were closed and made available, he continued to cry he did not have them, even though he was told several times they were available. He waited another year. Then, he cried about them in court again just a short while back. Again, he was told they were available and the funds were approved. Again, he complained about not having them at the next hearing. Again, he was told they were available, but then he claimed the funds were not approved. Judge Perry made it clear the funds were approved and further delays would not be tolerated.

Now we know that Jose has spent about $4,000.00. However, the CD’s were a little more than $2,000, yet Jose has spent the bulk of the $4 grand on a PI. So, do you think he ever picked up those tips?

So before they had Judge Strickland removed they had an issue for appeal but by getting rid of him poof Judge Perry took it away from them and gave them sticky tabs to aid in Casey’s defense. Major booboo on the part of Baez or whoever put the thought into his head to insult Judge Strickland in such a public way! And to boot he gave Marinade Dave a larger audience!
I wonder if Casey really knows what her defense is doing to her case! To me, it looks like they are going for a really long and winding Made for TV Movie and Mr. Baez & Casey have not found the actors they want to portray them!

I read on marinade Dave’s sight that Casey’s commisary account was almost 50.00 in the hole! He said George has not added money to her account since she accused him of sexual molestation. I say personally, way to go George! It high time he stood up for himself. As I have stated several times, I believe he is done with her. Which would be great! I know she is his daughter, but he is the one I had hopes for since the beginning! Hopefully she will not get money anymore. She does not deserve goodies, and hair ties, shampoo and conditioner. I agree that Bozo goofed big time when he got rid of Strickland. I wonder if maybe he didn’t really mean to get rid of him but just wanted to embarrass him or something? But it backfired!

Anyway, Bozo has always been able to sit and read ALL the 4,000 files. Linda Drane-Burdick did it. Even Sindee and G’s lawyer, Conway did it. All they or Bozo need to do if they see something of interest is put a tab on the page.
Then they can get that file. Also, TES already turned over the files of the only people anywhere near the actual area where Caylee’s remains were found. Other people the defense have mentioned were at the closest – 3 football fields away.
Unfettered access is a license to harrass people. Good people. And there is a precedent for it with a case involving blood donors.

Anyway, Mason already told the media that the area was impassable at the time! lol!
That’s exactly right! It was! So it’s clear to me that Bozo is acting in bad faith.

m2c- I understand that and I totally agree with what you are saying but it’s incredulous to think an investigation could or should be restricted no memory only! Look at all the documents that the State released some are sheer nonsense, i.e. letters to Casey! Those people deserve whatever they get in the way of publicity! I don’t want any innocent person dragged through the mud but people who get involved need to know that there are lawyers out there who will do anything to win their case (and I mean both sides) and your goodwill be damned if it interferes with what they want to prove. Judge Perry is a very astute, well versed Jurist and I believe he will do whatever it takes to give Casey a fair trial not only because of appellate issues but because it is the right thing to do. Baez made a big mistake on having the first judge removed. He would imo, have had an appealable issue on the TES info.

Hi, Alex! Nejame was trying to protect the privacy of inncent TES volunteers. I commend him for that. Bozo’s unlimited note-taking could have just been names and addresses to feed a database – as someone else suggested – to see if anything pops up. Bozo can’t be trusted – he’s a sleazy slimeball liar.

What Bozo COULD do before and has to do now too is put a tab on any person’s file that he wants to. Then the court will decide about it.
And I’ll bet Judge Perry is going to keep a sharp eye on what Bozo does with the info.

Merrigan- while I think the defense is looking to find a TES person to blame it on or at least give them 15 minutes of shame, the original order was way too restrictive, not being able to take notes, they could have done the investigation on Casey’s dime (whever she got the money from to pay Baez) if they originally could take notes, now the people of Florida are going to have to pick up the expense.
I believe Casey is Guilty but doesn’t mean she isn’t entitled to a fair trial.

There was a little Casey Anthony news today, and WFTV-Ch. 9 supplied headlines. Anthony doesn’t have any money in her jail account, WFTV reported tonight.

How did this come to be? “George Anthony has not put any money into jail account for nearly two months, not since the news broke that he wrote Casey an angry letter responding to her allegations of sexual abuse,” anchor Martie Salt said.

Yes, such allegations would anger a parent.

The bottom line? Anthony owes the jail more than $41, Salt added.

LOL, m2c! I do beleive LDB will corral those wayward squirrels and their nuts all in due time. I dont believe there is a Statute of Limitations on things like conspiracy, co-involvement, willful interferance and omission in a death. The trial hasnt started yet and these omissions, etc. are still being generated. If the trial was over lets say for a few years and then things started coming out, its after the fact, but it still would hold weight. Sort of like when somebody swears this and this happened when it didnt, trial is over and person is in prison for 20 years, then somebody pops up and says I just said that because I thought it would help or whatever and it actually can be a prisoners blessing, if wrongly convicted when more parties were involved. When somebody puts themselves in the act of a crime, like the squirrels have done, it just does not go away.

Maybe not! I believe Linda Drane-Burdick got Spindee to testify (confess), under oath, to doing exactly that (during the last hearing)! lol! I don’t know if there is a statute of limitations on that kind of thing but the state sure has a pile of evidence against C and G.

I wonder why Boez’s investigator is not looking for an alive Caylee or is Dominiccki still on that trail? I think that utterance was said to only build up the momentum that Cindy has gone by the wayside and cant make any good decisions in court, short of dellusional and all that-Cause for dismissal on her testimony-hope NOT!. Like I said before, did she only wash the pants because of the smell, (washing them and left for work, shoot, no wonder the machine broke down, yea right) or did she wash them because somebody elses DNA was on them? I say that only because she didnt do a very good job cleaning the trunk and they seemed to own every cleaning machine known to man to steam clean that trunk liner in a matter of minutes.

OT. I had to go to a courtroom today and the rule is you dress accordingly-no tank tops, no flip flops, etc. Within minutes I had seen at least 100 peeps in that type of get up. Court personnel were the complete opposite, looked like they all came from New York; winter weather/color type of clothing.
I know Cindy was there to answer Q’s about the call, etc., but I wonder why her lawyer didnt go up to the table when she spoke? He is bare minimumn advising them. Always found it strange they got a criminal lawyer, why? Immunity deal, Why? I bet we will all find out what the heck they are hiding.

If I had washed the decomp from my daughters slacks and cleaned a car trunk, I’m pretty sure I would be in jail now, much less telling LE the car smells like a dead body has been in it! Hi Everyone! I saw Mallory in the courtroom but didn’t get to see her shorts as she was sitting down next to Lee.
Do any of you think its strange that Lee says things about his mother, i.e., she choked Casey when they got into a fight when Cindy got back from visiting her dad on father’s day, Cindy hit the bed next to Casey trying to get info from her etc… It seems like Lee was starting a defense for Casey from the beginning and he doesn’t seem to be afraid of her, he even moved back home to help them financially! So odd!

Thank you for the info at 3:53, JB. I think JP asked the prosecution to respond to Bozo’s request to seal it so let’s watch for a motion about that. Although,maybe the prosecution doesn’t care. I get the impression they pick their battles which is very wise. So we’ll have to wait and see.

ORLANDO, Fla. — Prosecutors in the case against Casey Anthony turned over a tape that the defendant’s lawyer does not want to be made public, WESH 2′s Bob Kealing reported Wednesday night.

The tape is a recorded phone call of Anthony’s attorney, Jose Baez, talking to a state prison inmate who claims she conspired with other prisoners to make up stories about Anthony.

This week, Judge Belvin Perry said he wants to review what’s on the tape behind closed doors before he decides whether to release it.

Baez said the inmate called him and he was unaware that the call was recorded.

Anthony faces first-degree murder charges in connection with the death of her daughter, Caylee.

Hopefully Perry will rule on it next week sometime if not before! I have a feeling Bozo said or did something very damning to his case on this call. I don’t know why else he’s freaking out so bad about it because they’ve already disclosed the reason for the call. And if that is the case why aren’t they shouting it from the rooftops? Because Bozo blundered yet again! LOL

Oh COME ON Perry! Release it! The Sunshine Laws dictate that it should be released upon request!

Can’t wait till Tony Lazzaro is up in the witness stand. KC’s looks and mannerisms will be very interesting to watch.
Anyone notice when CA was testifying – Anytime CA stated the slightest bit of incriminating truth KC would look stone straight ahead and her eyes would glaze over a bit like she was in some kind of trance. Ironically, the manner is very obvious when she confirms that KC’s behavior that day seemed like she was stonewalling. It must be some sort of protection mechanism she’s (KC) been using for years.

I can not grasp how this family can disrespect Caylee the way they do.Why are they not shouting at the top of their lungs for LE to find the person that did this if Casey is innocent.
IMO…George and Cindy will be run over by the bus.Casey will say she has been protecting them since day 1.Not going to work Baez!!!!!

JB it was reported that Mallory was at court wearing short shorts. I wouldn’t know her if my lawn mower ran over her – oh, THAT’S what she and Lee had been doing just before court! Yard work! That’s why they were dressed that way! lol!

And before people start accusing me of being a snob or whatever, yes, I do believe that even in 2010 people should show a little respect for a court of law. Yes, even in Florida (and other very warm states. After all it IS air conditioned inside!)

At last week’s hearing I think Judge Perry asked Mark Nejame to submit something and MN said he would do that today. I’m not sure what it is – possibly a response to whatever happened at the sidebar.

Also, JP mentioned something about MN filing something regarding bad faith (about Bozo and Mason I guess) but I have not seen that either.

If anyone sees news info about either of those things, will you tell us please? TIA

His younger siblings are close in age and close relationship wise, but my brother-in-law would NEVER mouth “I love you” to my sister-in-law in a situation like that. Wow, I didn’t know that Mallory was pregnant. I had read that she finally kicked Lee out because she thought his relationship with his sister went way beyond the icky factor and too many things unsettled her. He moved back in with his parents. She also said Lee and everyone else in the Anthony “family” know exactly what happened. I can’t remember where I read that.(Maybe in an issue of “People.”)

CMA, that whole CMA thing at Caylee’s memorial was so ODD and disquieting. He even said he was PROUD of her.(I mean, REALLY ??? Can anyone wrap their minds around WHY or WHAT he’d find so noteworthy about her behavior?) I’m sure Lee WOULD want to name the baby after his psycho sister! RUN MALLORY RUN!

I bet that cruise ship was always lopsided. If the Ant’s were in the front, all 2000 of the other passengers were pressed against the rail on the back of the ship.

If the Ants were on one side, all 2000 of the other passengers were pressed against the rail on the other side of the ship.

The poor captain probably had a hard time keeping that ship upright. I’m picturing shots from the movie “Titanic” when the ship was going down.

Seriously, if you notice in all the pics of the Ants on the ship there really is NO ONE else around! Dang, I guess the other passengers may have jumped overboard when they found out the Ants were on board! Personally, I think I would have had the captain drop me off at the first thing that resembled land!

And you know….George missed a GOLDEN opportunity. He could have gotten all romantic with Cindy….told her he wanted to re-enact that scene from Titanic…with the girl standing at the front of the ship….leaning out over the water….NOT hanging on to anything…..then….WHOOPS! methinks- here in Sacramento County, the bailiff tells everyone to turn off their cell phones and get rid of any gum you are chewing. I’ve seen a bailiff walk up to someone and have them spit the gum out into a wastebasket, then warn them a contempt charge would be next. If a cell phone goes off in court the phone is taking away and the person is asked to leave the courtroom. I don’t know how long the hold the phone. So in Florida it’s apparently ok to chew gum, can you also have cell phones on?

LadyDay- I think it would not matter how many gas cans George had in the shed Casey would have taken all of them if they had any gas in it as she doesn’t seem like the type of person who would pay for something she could get for free. You made a click go off in my brain about Tony being with her when she got the cans. How did she explain to him why she needed two cans one would hold enough gas to get the car to a gas station! Did she not want to tell him she didn’t have any money? And the wedges, never really found out if George ever got them out of Casey’s car.
