		<description>OK I can see nothing I can say in here is going to stop all this bickering. I can see also that the word IGNORE means NOTHING to some in here. I have warned everyone before this and I am seriously tired of warning, so I am forced to shut this thread down with the comments. I apologize to those that are in here only to discuss what happened to little Haleigh Cummings. No one can blame me for not trying to be fair in here and I honestly have tried to but unfortunately I have been pushed into a position that is not fair to me now. To blame one side would be unfair because from my point of view I see blame on both sides and unless I ban the main three involved I don't see any other solution but to just shut the thread down with the comments.

I know I don't have to call out who the three are but I would like you three to know you are to blame for this. None of you would let the original argument go, which by the way was ridiculous to begin with. I have told you all dozens of time that everyone is entitled to their own opinion but you insist on having it your way and now thanks to that everyone else is going to have to suffer from it.

The other threads will still be open but I am warning you right now, if you go to another thread and carry this feud with you then you will be banned no matter how many others will disagree with me. So think of this as a new beginning if you still want to participate in the discussions. Mo more fighting will be allowed. I want BNN to be a comfortable place for everyone to discuss things but some seem to be determined to keep that from happening.

EVERYONE is welcome to post comments here, they are welcome to voice their opinions even if no one else agrees. PLEASE remember this when you want to disagree, which can be done in a civil way though.

Once again I apologize to the innocent ones for having to do this.

I will wait to see what others have to say before believing Tommy, I remember Cobra saying that jail was a hell hole in the summer so why does he feel he deserves better treatment then anyone else thats locked up? jmo</description>

We don't know for a fact TN refused to baby sit that night, that was what Misty supposedly said to Chelsea. Funny that tidbit didn't come out till after she was put in jail.</description>

Whether Tommy is lying or not, LE should have tapes/videos to refute Tommy’s allegations. I have a problem with LE trampling all over someone’s constitutional right and not expect them to say or do anything about it. If Tommy is guilty of anything involving Haleigh, LE could very well have ruined their chances of prosecuting him with their gross misconduct of the law. This is one law that the justice system takes very seriously. Werter is Tommy’s attorney for the drug trafficking and when LE decided to question Tommy about Haleigh, they knew Werter should have been contacted and the questioning ceased until Werter was notified. They didn’t and it shows a total lack of integrity on their part and in this investigation. JMO

		<description>Mlee--According to the newspaper accounts (IIRC) that LE never denied "questioning" Tommy. If they just wanted to talk to him all they had to do was "talk" to him in his cell--not forcibly remove him from it. He is in jail for drug trafficking--not Haleigh--so LE knew to contact his lawyer or let Tommy do it. I have never heard of LE questioning anyone and not expect a response. Whether Tommy is lying or not, LE should have tapes/videos to refute Tommy's allegations. I have a problem with LE trampling all over someone's constitutional right and not expect them to say or do anything about it. If Tommy is guilty of anything involving Haleigh, LE could very well have ruined their chances of prosecuting him with their gross misconduct of the law. This is one law that the justice system takes very seriously. Werter is Tommy's attorney for the drug trafficking and when LE decided to question Tommy about Haleigh, they knew Werter should have been contacted and the questioning ceased until Werter was notified. They didn't and it shows a total lack of integrity on their part and in this investigation. JMO</description>

		<description>OJ- I think these lawyers are all pro bono, not public defenders, and imo opinion they are killing two birds with one stone. First they are showing the compassionate people how they are working selflessly with no renumeration for their poor client. Then to the other side, I gave them representation so they could not complain that they only had a PD and challenge the sentence after it's given.All they are out for is Publicity for themselves, their representation of these clients is shameful and the publicity they receive is probably worth more then any payment he/she would have received from the court! jmo</description>

Going back through the week prior to Haleigh gone missing.. More questions come up than there are answers for.

We know that Hank Sr. claimed on video of his conversation with ron on wed night.. early Thursday morning February 4 -5th, around 1:30am, that ron called him on the phone, and ask: Is Misty at your house. and Hank responded NO.. Ron stated, I'll go look for her. Whereas Hank Sr. said, are you gonna leave the kids home alone?? Ron stated, they'll be okay, they're sleeping.  

Now, this opens up the door for many questions.
and the first is to answer right off the bat, do we believe or want to believe what Hank said?  Answer, why would he lie about that??

Second, this fight on Thursday during the day, brings in far more questions, since Haleigh was Absent from school that Thursday, which puts her and Junior right smack in the middle of a fight, which has been told occurred, and told by family members, he did throw her out of the house, and then on his way to work, he did drop her clothes off at Tommys. And that TN did babysit the kids that night.

Now that weekend, from Friday after Haleigh got out of school, and she was marked at school, until Monday.. No one knows anything other than ron had the kids!!  Now, my question, if Ron had the kids from Friday after school through Monday.. How did ron go to work on Friday night.. NO, the kids were not with tn, nor with GGSykes.. I had ask the question directly, was crystal with ron and the kids that weekend, and was told NO!! but she was sure burning up the phone!! Well what did ron and the kids do that weekend?? Did they stay at the house, go shopping (no detergent) go visiting, well whom did they see?
Who saw them together??
See, this open door leaves far more questions than given answers.  

As a Grandmother, I have set and ask myself questions. If one of my Grands disappeared, Lord Forbid..  
How would I react??  What would be so valuable for me to remember?? 

I do believe that every second of time that I spent with that child would be become burned into my brain.. I would have wanted to know everything she did or said for that entire weekend prior.. Those would become part of me, and my life without her.</description>

Ron stated, I&#8217;ll go look for her. Whereas Hank Sr. said, are you gonna leave the kids home alone?? Ron stated, they&#8217;ll be okay, they&#8217;re sleeping.  </p>
<p>Now, this opens up the door for many questions.<br />
and the first is to answer right off the bat, do we believe or want to believe what Hank said?  Answer, why would he lie about that??</p>
<p>Second, this fight on Thursday during the day, brings in far more questions, since Haleigh was Absent from school that Thursday, which puts her and Junior right smack in the middle of a fight, which has been told occurred, and told by family members, he did throw her out of the house, and then on his way to work, he did drop her clothes off at Tommys. And that TN did babysit the kids that night.</p>
<p>Now that weekend, from Friday after Haleigh got out of school, and she was marked at school, until Monday.. No one knows anything other than ron had the kids!!  Now, my question, if Ron had the kids from Friday after school through Monday.. How did ron go to work on Friday night.. NO, the kids were not with tn, nor with GGSykes.. I had ask the question directly, was crystal with ron and the kids that weekend, and was told NO!! but she was sure burning up the phone!! Well what did ron and the kids do that weekend?? Did they stay at the house, go shopping (no detergent) go visiting, well whom did they see?<br />
Who saw them together??<br />
See, this open door leaves far more questions than given answers.  </p>
<p>As a Grandmother, I have set and ask myself questions. If one of my Grands disappeared, Lord Forbid..<br />
How would I react??  What would be so valuable for me to remember?? </p>
<p>I do believe that every second of time that I spent with that child would be become burned into my brain.. I would have wanted to know everything she did or said for that entire weekend prior.. Those would become part of me, and my life without her.</p>

In California if you are in jail convicted of a felony you still have a right to vote and they will even supply you with voting materials. The 9th Circuit Court of Appeals heard a case from the State of Washington in which they decided that minories were being disenfranchised because so many were in State Prisons and therefore should be allowed to vote. This to me would mean that if it is okay for the State of Washington to allow all prisoners to vote then the other states under the rule of the 9th Circuit would have to grant that right to their prisoners!</description>

I think when all of the truth finally comes out, all will find that ron had far more control over all three girls, crystal, amber and misty than anyone realizes.. 

Control can be in so many varying manners, through anger, rage, violence.. Look at how many abused women in this country, remain with their husband and boyfriends, thinking its gonna get better.. they stay, the endure, and most of them believe its their own fault that hubby or boy friend is having to control them. If they were more submissive and did what they were told, he would have to be aggressive or cruel, or mean to them. And that is done through manipulation. And one thing I am convinced of, ron is a manipulator.</description>

Okay, now were cooking.. Tommy has pled out, he is now a convicted felon, he convicted himself, Tommys constitutional rights are already effected. He should have already lost his right to vote in this country. 

1. He is under the guidelines of the Putnam County Jail.

2. I don't think he can refuse to leave his cell, or refuse to be interviewed, he can refuse to speak, but he cannot refuse to listen.

Miranda:
You have the right to remain silent. If you give up that right, Anything you say can and will be used against you in a court of law. You have a right to an attorney during questioning. If you cannot afford an attorney, one will be appointed for you.

3. If Tommy is not ask any questions.. His Miranda rights are not violated.

4. If the entire interview contained nothing but comments made to Tommy, and no direct questions of Tommy.. His Miranda Rights are not violated.

5. Tommy's current attorney has no legal binding on restrictions regarding the Haleigh Case. Because he has made a public statement that he would not represent Tommy in this Case.

6. If No questions were ask of Tommy pertaining to the case he has just pled out to, and he convicted himself, his attorney has no jurisdiction, he is only representing his client on the drug possession and trafficking.

7. Every time a person is questioned or interviewed by LE on a specific case, does not necessarily require being given their Miranda Rights. Once Given.. thus effective.

8. Anyone who refuses to an interview with any LE can be held for up to 72 hours, without being placed under arrest.  And during that 72 hours, as long as you have received your Miranda rights, and you do not need an attorney if all is done during that interview are statements made to you.. and no questions ask!!</description>

Here in California, I don't know how often it is used, by a judge can sentence a person to a long prison term, but can recall that sentence in a period of less then 90 days in some cases because it was deemed they are not prison material. In essence the 30, 60, 90 days they have spent in prison was enough to show the court that the inmate was not only remorseful but that the point has gotten through to them to walk the straight and narrow. The sentence is then set aside but can be reinstated should the person commit another crime!</description>

Hope's lawyer should find another line of work IMO or if she's going to continue as a lawyer she should openly work for the prosecution.</description>

Hope should have been sentenced as a youthful offender and I believe the judge errored in his reason for not sentencing her as a youthful offender. Hopefully she will get a new sentencing based on that possible error and be sentenced as a youthful offender.

Obnoxious or not, whether we like her or not, no 19 year old should go to jail for 15 years for the small part that Hope played in the "drug dealing" that she participated in.</description>

But, I think hope plead to a min/man charge so the judge gave her the minimum which was 15 years, right?

Her mouth wrote a check her butt couldn't cash. :)

She does have an appeal filed. That will be another juicy hearing. She signs off on the plea, pleas, then doesn't like the sentence and appeals it. That's going to be a tough on to turn over, but hell, let hope have her day by law and move on.</description>

I don't think that PCSO would put their necks on the line to that extent, and I do think there are pertinent issues at hand, that will cover their need to interview him.. And if he refused to leave his cell and co-operate, that speaks for itself also. He is out of his comfort zone, and much like misty walking out on interviews early on, because the detective was rude to her.. follows the same lines.  If I don't want to talk to you, I don't have too.. that in itself is very childish and not going to be tolerated.  Tommy is their guest at the Grey hotel.. And since he made statements that he based on misty's world of inmate fantasy. They do have a right to come back and say, hey you.. we want a bit of truth out of you.. you lied to us...  And to boot, this is not going to go unnoticed by the Judge, that Tommy is going to be standing in front of.. who will be issuing a sentence for him.. which in short, one case should not reflect on another.. Tommys track record of court cases, over the years.. involved in violent actions, thief of weapons, and his stories as per Haleigh, drug activity, dealing.. all must be considered by this Judge on the issues of sentencing him on the drug charges. Tommy could well be considered a lifetime criminal, one they just don't want to ever hit the streets again, and no sympathy given, which could mean the rest of his life in the state Grey hotel..  This is what bit Hope in the Butt. Her attitude, her conversations with her mother, her past charges, the Judge decided.. this one needs to be put away for a long time, she will not be rehabilitated. No Sympathy..</description>

They do have a right to come back and say, hey you.. we want a bit of truth out of you.. you lied to us&#8230;  And to boot, this is not going to go unnoticed by the Judge, that Tommy is going to be standing in front of.. who will be issuing a sentence for him.. which in short, one case should not reflect on another.. Tommys track record of court cases, over the years.. involved in violent actions, thief of weapons, and his stories as per Haleigh, drug activity, dealing.. all must be considered by this Judge on the issues of sentencing him on the drug charges. Tommy could well be considered a lifetime criminal, one they just don&#8217;t want to ever hit the streets again, and no sympathy given, which could mean the rest of his life in the state Grey hotel..  This is what bit Hope in the Butt. Her attitude, her conversations with her mother, her past charges, the Judge decided.. this one needs to be put away for a long time, she will not be rehabilitated. No Sympathy..</p>

I think they needed pills and went to Misty's go get them that night. Misty said she called TC and asked him why he kept calling her house all day. TC wanted to come over, Misty said no, but TC and parents came over anyway. Fight ensued. 

I do not believe that Misty was "forced" to stay anywhere she did not want to stay. Her own father said he could not control her, that she did what she wanted, that she even left the state to go be with some guy up north. But we are to believe that Ron controlled her only after a few months? He didn't control her enough to keep her home the days before Haleigh disappeared.

I don't buy that for a second. Misty left when she wanted, stayed when she wanted, and pretty much did what she wanted for at least a few years before she even met Ron and his family.</description>

Do believe she is currently under social security disability receiving monthly checks.. those might well be a permanent fixture.</description>

		<description>Mlee, I think you are right in that Tommy is out of his safe zone in PC and this is the main factor in all his complaints. He is now scared and he's lost his confidence, so he's creating issues in any way he can think of.

The thing that struck me, after reading all the comments, is how many people immediately believed Tommy's accusations against LE and have come to his defense! Tommy has demonstrated that he is a liar again and again. Why would anyone ever believe him? A defense attorney's job is to paint his client in a perfect light and everyone else in as negative light as possible. If a defense attorney could get away with convincing the jury or the public that little green men came down from the sky and did the crime instead of his client, he would do so. So I would take anything that Tommy and his attorney say with a big grain of salt.

That being said, I agree that PCSO must be very angry at Tommy and it is possible that they could have stretched their boundries, because they are human. But they also know the law and know how any indescresions on their part could backfire on them. If they recklessly left Tommy in a situation where he could be seriously injured or killed, how the heck would this help the Haleigh case that they have worked so hard on?

The truth is probably that they are making Tommy as uncomfortable as they are legally allowed, and may be pushing the limits, but stopping just short of abuse. Tommy and his attorney are probably expoiting every opportunity they can to cry foul.</description>
