An appellate court in California has upheld a verdict where a woman and her husband were awarded twenty million dollars after the woman contracted the asbestos cancer known as malignant mesothelioma. Joan Mahoney was exposed to asbestos over a number of years as a result of remodelling houses.
According to reports Joan was a singer by trade, but she and her husband worked on remodelling houses for a number of decades. As a result of this work she was regularly exposed to asbestos dust and fibers, which we now know can lead to a range of serious health problems including asbestos cancer.
She was diagnosed with mesothelioma in 2006, and because of her illness was unable to car for her husband who was paralyzed. A lawsuit was filed against a number of defendant companies including Georgia Pacific, Bondex, Kaiser Gypsum, Durabond and CertainTeed.
A court ruled in favour of the couple, but the award was reduced from twenty million to just over six million dollars. However, the appellate court has now ruled that Mrs Mahoney and her husband will receive the full twenty million dollars that was originally awarded.
