In what way do atheists misuse it?  The "establishment of religion" can take both blatant, as in the case you point out, and subtle forms.  For instance, insisting on the recitation of a pledge with the words "Under God" is a violation of the constitution.  Objecting to government officials leading students in prayer at government sponsored sporting events is a violation because it is tantamount to government endorsing one religion over another.</description>
