With a “hostile witness” I think the Lawyer has much more leeway … can even “lead the witness”. I guess everyone knows they don’t WANT to be there and could be reluctant and maybe a bit obstinate as we all know CINDY can be. Can act like they do on Cross … tougher, more challenging. THAT should be good!!!! Geraldo asked Cindy a question and she said “Are you friggin … oops” and caught herself. This was on TV. Nice Cindy and the chewing of the cud.

You can fool some of the people some of time, but NOT ALL of the people, ALL of the time.

CA - I think it’s more a matter of the kinds of quesiton that the prosecution can ask of a hostile witness, the way they treat him/her.
But it’s right that they don’t want to testify FOR the prosecution. That’s why they’re called hostile. I imagine that’s what the situation will be but I don’t know.

mb - The defense does not HAVE to cross examine every single witness if they don’t want to. But knowing grandstanding Bozo he probably will.
We’ll have to see if Bozo comes up with any additional witnesses (more than just experts). There is plenty of time.

The prosecution has to name every possible witness before the trial (although sometimes they’ll find one later on and try to get permission to add him/her). But they do not have to have every one of them testify. Let’s say they have 20 people who can testify to what a skank Maggot is. But the first five people to testify nail it so well the prosecution may decide not to call up the other 15 because the jury’s got the message and it’s smarter to move on before boring them or irritating them. It’s the kind of decision they make on the fly during the trial. So it might be that not all 100 (or whatever) will have to appear.

Beast - What you may be referring to is the “Will the defense stipulate that this witness is a firearms expert” (kind of thing) which would mean that the prosecution does not have to question the expert about his experience and qualifications to testify about that subject.
I don’t know that it’s used much as a substitute for testimony like Jesse and others would give. As you said it’s much better for them to appear in person.

But that is a tricky thing. Now, the jury has to be present for those types of motions. And I would think, a person sitting there giving testamony carries more weight than the state reading it, and defense agreeing. example…If jessie grund is going to appear, and say that Casey was a sex fiend and was always hounding him and wanting to party. The jury seeing him, his body language, and his disgust for her, would make more of an impact than just Baez stating that yes the defense will agree to “this and that”.

The prosecution has the option to call every witness. However. If the defense enters a “willing to accept testimony” motion they do not have to appear. Im sure thats not what it is called, but basically means if the defense will accept what that person is going to say then no need for them to appear.

Hi CAPY - 6:44 I was only married to a lawyer, and I’m blonde! Ha ha ha ha but I will try here. Maybe some others know more and will help.

Hopefully the Prosecution (the State) can put on it’s full list of witnesses. After all, if they think the murderer is guilty, they should be allowed to try to prove it - fully.

I don’t know if BOZO has any control over them at all tho. Too, I would imagine the Judge will try to keep it moving along, because they are usually mindful and respectful of the Jury and their time away from home. This Jury might even be sequestered and kept away from their families for that entire time. That costs lots of money too, lots.

COULD IT BE that the Defense is jealous? What will they have 6 witnesses or so? C, G. Lee, maybe 3 more? I wonder who …

Me too - I don’t see HOW this can all be over in a month with that Witness List and BOZO’s ineptness and lack of experience in Court. He might go on forever making a “noise like a lawyer” - trying to impress his client and future clients, and just wanting “air time”. What a fiasco awaits us. He will, won’t he, pick apart every single little thread he can find, trying to DESTROY credibility, forensics, witnesses, experts, etc. After all, HE has something to prove here in this convenient ARENA he will find himself in, that he is a GREAT LAWYER!!! Heart - I’ve been wanting to ask a question, without seeming blond.

Let’s say the Prosecution has 100 witness (they have more, actually). Will they put all the witnesses on the stand? To make a trial less complex, does the judge weed out some witnesses. Does the Defense have a say in it?

The reason for my question, is on the new article someone said the trial is expected to last a month. If there are going to be OVER 100 witness from both P & D and cross-examination from both sides, PLUS explaining all the forensics - seems the trial would continue for much longer than a month.

I don’t know how many witnesses OJ’s trial had, but it got pretty complicated after awhile.

Not sure of all the details of how it works, really. I just know my ex got forwarding fees when forwarded a case to another lawyer. This was in PA. There was nothing illegal, it was done all the time, and is legal. Called Forwarding Fee.

In my lifetime I have tried then not to ask other lawyers who to use, because I figured all it would take was one phone call … “Hey you might get a call from ______________ I recommended you to her.” I thought too then, I wasn’t such a valuable client then. He wasn’t going to make the full FEE, from me. Thought I might get better care if I searched around myself and got my own…?

I am sure they don’t talk about it much to the public either. Maybe you have a lawyer, or know one you can trust, and can ask them if you want.

Just wondering… since we know BOZO is the way he is, in general. So above board and trusworthy. I would imagine all kinds of things can go on behind closed doors if one is without morals. WAY WAY outside of what is “legal”. Maybe even kick backs … who knows with them? I trust all of them as far as I can throw the local High School.

Then we should remember there are amounts like $20,000. - and there are also amounts like $1000. All good when you are a new lawyer just out of law school - 3 years, and you are representing indigent inmates. Did he work for the Govt.?? Salary?? Wonder what that was a year, if so? $35,000.???

Tori, I googled Linda Kenney-Baden and was blown away by her experience. She has a LOT in BIG cases I am sorry to say. I’m sure she contacted Bozo. She probably thinks she’s helping some “poor girl.” I really don’t understand what motivates people like her.
