A couple has filed an asbestos lawsuit, claiming that as a result of exposure to asbestos dust and fibers they have both gone on to develop asbestos related diseases. The lawsuit has been filed in Madison County Circuit Court, and the plaintiffs are Michael and Madonna Sue Poninski.
According to the lawsuit they have both developed asbestos related diseases because of Michael’s exposure to the deadly substance. He was diagnosed with lung cancer and respiratory problems in 2007, whilst she was diagnosed with asbestosis earlier this year.
The report states that Michael often worked around hazardous substances and toxic fumes whilst working for BNSF Railway between 1971 and 199, where he was employed in various capacities such as conductor, switchman, and brakeman. His wife said she was then exposed to the hazardous debris from the clothing that she used to wash for her husband.
The lawsuit accuses BNSF of negligence for failing to provide a safe work environment, failing to provide protection equipment, failing to inform workers of the dangers of exposure, and allowing the exposure to occur.
