The Obama birth certificate issue may become an issue.
Phillip Berg may have had his case dismissed in a Philadelphia federal court for lack of standing, but cases filed in the last few weeks in eight state courts are still pending over Barack Obama’s citizenship issues.
Berg says he plans on appealing to the U.S. Supreme Court.
Our opinion: the appeal will likely be denied, due to the standing issue.
Berg filed suit in court to force the Democrat nominee to produce an original “vault” copy of his birth certificate. Obama and the Democratic National Committee chose to fight the lawsuit, rather than produce the birth certificate.
Obama left the campaign trail for a few days last week to see his ailing grandmother in Hawaii. Rumors swelled over the timing of the visit. DBKP took the campaign’s announcement at face value.
Yesterday, it was reported that the Hawaii Governor, Linda Lingle, has had the Obama birth certificate placed under seal.

The governor’s office officially declined a request made in writing by WND in Hawaii to obtain a copy of the hospital-generated original birth certificate of Barack Obama.
A source told World Net Daily “…confidentially the motivation for withholding the original birth certificate was political, although the source refused to disclose whether there was any information on the original birth certificate that would prove politically embarrassing to Obama.”

I don’t understand why Obama refuses to produce the actual birth certificate. This puts real doubt in my mind that he is as honest as he appears. I enlarged the document and spotted a blue stamp of June 6, 2007. I believe this is a fake document. If we can’t trust him now, how can we trust him to be president?

Intriguing that this flurry of activity only surfaces after Obama’s lead in the race has solidified & increases daily with only a week to go. Just two of a number of pieces of evidence that blow this idiotic “theory” completely out of the water:
1. Obama has traveled abroad (obviously under a US passport) for years — if there were a defect in his credentials, Occam’s Razor says it would have been discovered long before now. 2. An announcement of his birth was published in the Honolulu paper a week following his being born.
To believe the supposition that Obama is not a US citizen would necessarily require buying into one or both of two completely absurd inevitabilities. Either (a) The State Department & DHS (who control ingress, egress, & return of *all* persons to/from the US) are staffed top to bottom by utter incompetents, &/or (b) the Honolulu press would have had to be in the position of knowing *50 years ago* that an obscure black infant would run for President against a candidate rendered highly vulnerable by ties to an incompetent administration.
Obviously both of those scenarios are so ludicrous as to beg even the slightest credibility. This is clearly politics of desperation & a willful delaying action with the intent of negating the will of the electorate. The first of those is somewhat understandable. The second is not. Why?
Because there is a word for it. “Treason.” Read Judge Surrick’s ruling & his assessment of the merits of Berg’s accusations. (The word “thin” is highly prominent.) *Then* tell me which side in the case is the one trying to pull a fast one.

If people judged Barack Obama by the content of his character and not the color of his skin, he wouldn’t have been chosen as the Democratic nominee in the first place. Hawaii is or was one of the only few states that would offer a vault birth certificate to any US Citizen if they claimed their child as US Citizen but they would have listed either Kenya has original birth. If he wasn’t born in a hospital there would be no listing for that either. If you search this subject you’ll find that there has been discrepancies even in where he has said the hospital in which he was born. He has said one hospital his step sister has said another. He has alledged to never have changed his name or have been adopted but his wife in an interview confirmed that he was. If he is of such high moral standards than he shouldn’t have a problem with showing his original birth certificate…oh and by the way the one that is on his website has discrepancies too, like a laser date at the bottom that wasn’t available in 1961 not to mention that the seal and dated signature does not show up as a “bleed through” search Hawaii birth certificates and you’ll find that when a birth certificate is scanned into a computer you can still seal the original seal and signature. Do your research.
This is not a black/white issue. This is an issue concerning the welfare of all American citizens today and for years to come. I have listened to the debates and read numerous articles on both candidates. One day I like Obama’s ideas, and the next day I like McCain’s ideas. If Obama is indeed a natural born American, he needs to prove it. Right now, I am beginning to lean more and more towards McCain.

But the proof does not have to come from requiring Obama to prove that he is a citizen. It must come from the people who claim that he is NOT a citizen. And they have no evidence.
No, the assertion that there is an audio tape of someone who claims to be his paternal grandmother and claims to have attended his birth when his mother was in Kenya is NOT evidence? How do you know from a tape that it is really his grandmother?

Kenya is not supposed to have any “records” for Mr. Obama simply because “officially” he was not born there. So exactly what records is Kenya trying to seal? If all Mr. Obama did was visit the country once or twice then there would be no need to “seal the records”. Am I missing something here?
It is actually quite simple, if there is nothing to hide, then don’t act as though there is. If Obama is a U. S born, U.S. citizen, then just prove it. End of story. No place else to go. If Hawaii “sealed” their birth certificate, then there is something being hidden. Having been adopted myself, I have two birth certificates. My original one and then the new one that was issued after my adoption. They are quite different. They are both “official.” If Senator Obama was not born in this country, Hawaii could still have produced a secondary birth certificate to validate his citizenship, but not prove his actually having been born here.
This has nothing to do with “white washing” this matter. This has to do with the law and smoke and mirrors. Obama’s entire campaign and career in the Senate has been for this moment. Focusing on the Indonesian citizenship from his childhood, if he cannot produce documentation showing a renouncement of his Indonesian citizenship and oath of allegience to the United States, then this is actually a matter for INS. He is actually an illegal allien subject to deportation without verifiable citizenship documentation. I would also think that his current US passport would have been obtained fraudulently if his US citizenship has not been re-established. It would apprear that he skipped the oath and just simply used the COLB from Hawaii to get the passport without informing anyone that he is actually an Indonesion citizen.

Nonsense, it is up to the Secretary of State in each state to validate eligibility of both voters and candidates. They must certify that a person can be on the ballot. This is why there is now 8 or 9 lawsuits in different states compelling the SOS to verify that Barak can be on the ballot.
It is possible that Obama was born in Kenya. His mother flew back to Hawaii and claimed he was born at their house. As Obama has stated he was born at a hospital. If the vault birth certificate states he was not born in a hospital, as he has said, that would raise additional questions to be raised.
This is not racist. A person that wants to be President needs to prove that they have the credentials to take that post. Obama is a very bright person and an attorney. He knows the law and it only raises more questions about why he has hired a legal team to fight disclosure of this information.
The question of the Hawaiian government sealing his birth certificate due to rights of privacy is likely heading to the Supreme Court to decide if the federal Freedom of Information Act trumps the Hawaiian Constitution.
Further, these law suits filed in State Courts will require Obama produce the information to show he is indeed a natural born citizen. If he cannot his name can be removed from the ballot now, or after the election. In other words, if he is elected and he is found not to be a natural born citizen he would be removed from office. Where it goes from there is going to be interesting. I am not sure Biden would be able to ascend to the Presidency as his right to do so flows from Obama. The Presidency could go to the next legitimate candidate with the most electoral votes.
Obama could avoid all of this by signing an authorization to the Hawaii government along with a $12.00 check. Instead he appears willing to risk what could be one of the greatest constitutional crisis since the founding of this country.
Here is a Michigan Law Review article that predicted that the Federal law suit Berg filed would be dismissed, but also states these suits should have been filed in State Courts.
Obama needs to produce the paperwork to end this. Should he be elected and he is found out to be hiding this information it will not be pretty.
Question: Has anyone else running for POTUS had to produce their birth certificate? For one John Mc Cain voluntarily produced his vault BC to prove he was “naurally born” in the US–and yes the Panama Canal Zone at that time was a US protectorate hence as good as Detroit.
Question: Was Barack born in Kenya? We may never know for sure unless the Kenyan or government or Hawaii open the records. But even if they don’t his adoption by his step father and subsequent citizenship in Indonesia and lack of any recorded Oath of Allegiance when he turned 18–necessary to re-establish his US citizenship–and his use of an Indonesian passport to travel to Pakestan all point to to dual citizenship and are reasons enough to diqualify him for POTUS.

I would really like to see the document that re-establishes his citizenship. Without said document, he is actually an illegal allien living in this country.
Employers are required to have an I-9 form for all employees. I presented my birth certificate and drivers licenses for citizenship verification. The Presidential Candidates should do the same.

The State of Hawaii sealed the ‘Birth Record’. A birth record can also be some stating someone was born at a particular time & place after the fact, NOT A CERTIFICATE, nor is that certifiable as truth. It can be record of his birth in Kenya with his mother being younger than 18, not valid as US born, but record of the birth to a US citizen.
Oh, what has Kenya sealed until after the election date? Why would they have anything to seal if there weren’t any such documentation in their possession?

I am in favor of Obama as I have analyzed both Obama and Mccain and have come to the conclusion that Obama is the better candidate at this time. I have an unbiased view because, well… I’m Canadian.
What is very troubling to be is this entire birth certificate issue.
Here is what I have found:
Factcheck.org removed all the metadata from the posted images at http://www.factcheck.org/elections-2008/born_in_the_usa.html . This may be insignificant but others state that the images had a March 08 date. I will give factcheck.org the benefit of the doubt that the camera had the wrong date.
The large image of the raised seal at factcheck is illegible! Seals have text legible text. This is the most significant find for me and I am very sad to discover this.
About the missing seal on fightthesmears.com, I can tell you that once you scan a document with a seal and make it low res with jpeg compression the seal will disappear along with crease lines. I have scanned hundreds of documents and this is a common issue.
What is very troubling is not the missing seal, it is the misaligned characters. It is complicated to do but I have constrained the birth certificate to a grid and text containing the names and variable information are misaligned while the static / template text is aligned.
I have come to the conclusion with hours of research and Photoshop work (I am a Photoshop instructor) that the birth certificate is indeed a fake.
Now that the Governor of Hawaii has “Sealed “ the Stat and Health records this only raises more questions.
My message to Obama (if this was up to me):
Obama, you’re going to create an enormous mess! Please create and release a better forgery of all the requested documents so we can move on. Surely you could have done a better job of this! You’ve had so much time.

I have to provide documentation to get a job, why doesn’t Barak have to provide documentation requested by his employer (me) that is on par with the level of position being applied for? It also begs to question why Mr. Reality & others continue to try and defend an undefendable position by Mr. Obama. I am a Democrate as is my Union husband. I first saw these allegations and blew it off thinking “Here goes the Republicans, trying to dig something up” BUT, then, because I like to be well informed about my candidate, I sat down last Saturday to do my own research.
After researching it all, I am now not comfortable placing my vote for Obama and neither is my husband.

This is NOT about politics, not about republican or democrat… it is about upholding the constitution of the

You all are, in fact, seeing history… You are seeing where the United States Constitution is becoming a meaningless document. Where it is shoved aside in order to allow someone who has decided to not fully identify themselves and their history.
Interestingly enough, I found that there IS no group who is responsible for verification of someone running for office. The individual simply has to “attest” that they meet the requirements.
I was going to vote for Obama until this “flap” came up. While I know I’m a small percentage, I’m now voting the other way.
There is just too much that does not pass the “smell” test.

Why are you able to believe known con artists with an open & avowed agenda, but apparently UNable to believe the undeniable fact that Not One Single Solitary Member Of Congress, NOR McCain, NOR Palin, NOR The White House (who do have, after all, the absolute most to gain if the allegations are true & verifiable), have come out & taken action on it?
Heck, Bush has even ordered the Attorney General to try to prevent legitimate voters from casting ballots in OH. Would he not use something like *this* if he had it handed to him on a silver platter? You know d*** well he would. So why, then, hasn’t he?

Why is Kenya sealing Obama “records?” Why would Kenya have Obama records to seal if Obama was indeed born in Hawaii? What’s the big deal if Mr. Obama is indeed a natural citizen? I am a retired peace officer and a life long registered Democrat. When I graduated from college I spent several hundred dollars getting dozens of certified copies of my birth certificate, college transcripts, and high school transcripts because along with every application I submitted for an entry level position with police/sheriff/probation departments that I applied to I was required to submit these documents along with copies of my diplomas. I also had to submit a list of all the addresses where I had lived since becoming an adult, and any trips I had made out of country. This information was used to conduct background investigations since I was applying for jobs that required a security clearance. Obama is applying for the highest office in the land and is refusing to produce these documents? Why bother fighting a case when it can be quashed by simply showing these documents to the judge if there isn’t anything to hide?
I am two years younger than Obama and was born in Louisiana. I was born at home and the only people present were myself, and of course I have no recollection of the event, my father, who delivered me and is now deceased, and my mother. I looked over my birth certificate recently and went over the information on it. While I am certain there are records from the doctors my mother took me to shortly after my birth, the actual deed was not registered with the Office of Vital Records by my father until six months after my birth, at the time we were getting ready to move out of state. It clearly states on the document the address and Parish where I was born. Obama admits in his book that he has a copy of this document, so why is he refusing to produce it?
I also went over my college transcripts and there are fields on it that indicate what your citizenship is as well as what grants, scholarships, and financial aid you received during your education there. I am sure that grad schools would have similar information on their transcripts as well. Again, if there is nothing to hide, why not simply produce the documents and put the rumors to rest?
I think that the most important information in this case is that he traveled to Pakistan in 1981, which is admitted by his campaign, which was a no travel zone for US citizens at that time as Pakistan was under Marshall Law. On his way there Obama stopped in Indonesia to visit his sister at which point, in order to get into Pakistan, he would have had to get his Indonesian passport renewed in order to travel to Pakistan. The only way he could have renewed his Indonesian passport would be to declare himself an Indonesian citizen (his school records from Fransiskus Assisi show he was recognized as an Indonesian citizen as a minor, http://www.daylife.com/photo/01u33pL9Ns06D), because in 1981 Indonesia did not recognize dual citizenship. This would mean that, AS AN ADULT, Obama gave up his US citizenship in order to get his Indonesian passport. If this is not the case, then Obama should not have any problems producing his US passport showing that he traveled to Pakistan in 1981. Records of this should also be maintained by the US State Department.
While POTUS is a federal office, it is the responsibility of the Secretary of State to vet candidates. My thought is that he has claimed his extensive travel and connections to other countries qualifies him to handle foreign affairs as President, so he should be required to produce documentation to support claims of where he has traveled (his passports), where he was born, as well as his college and grad school transcripts. I will ask the SoS office tomorrow to properly vet Obama as a candidate and demand that Obama produce the documents requested or be removed from the ballot. To be fair, I think that the same should be done for all other POTUS candidates, however I doubt that anyone else will have a problem producing the documentation. Again, all he has to do is produce the documents to put an end to all the questions out there.

The governor of Hawai’i is a Republican! If she has political motivations as you claim, it would be to seal the birth certificate since it is definitive evidence of his U.S. citizenship…NOT to seal it because it is evidence of the opposite. Get your facts straight! Also, the birth certificate on Senator Obama’s website is precisely what a Hawai’i birth certificate looks like (I know because I’ve given birth there).

Obama has released just one brief document detailing his personal health. McCain, on the other hands, released what he said was his complete medical file totaling more than 1500 pages. After criticism on the matter, last week the Obama campaign also released some routine lab-test results and electrocardiograms for Obama. All test results appeared normal, but many details about his health remain a mystery.
Obama has refused to offer his official papers as a state legislator in Illinois, and has been unable to produce correspondence, such as letters from lobbyists and other correspondence from his days in the Illinois state senate. There are also no appointment calendars available of his official activities. “It could have been thrown out,” Obama said while on the campaign trail during the Democratic primary. “I haven’t been in the state Senate now for quite some time.”
Obama has not released his client list as an attorney or his billing records. Obama has maintained that he only performed a few hours of legal work for a nonprofit organization with ties to Tony Rezko, the Chicago businessman convicted of fraud in June. But he has not released billing records that would prove this assertion.
Obama won’t release his college records from Occidental College where he studied for two years before transferring to Columbia.
Obama’s campaign refuses to give Columbia University, where he earned an undergraduate degree in political science, permission to release his transcripts. Such transcripts would list the courses Obama took, and his grades. President George W. Bush, and presidential contenders Al Gore and John Kerry, all released their college transcripts. (BTW, just to be fair…McCain has refused to release his Naval Academy transcript.) I think McCain should come forth with those too!
Obama’s college dissertation has simply disappeared from Columbia Universities archives. In July, in response to a flurry of requests to review Obama’s senior thesis at the Ivy League school, reportedly titled “Soviet Nuclear Disarmament,” Obama spokesman Ben LaBolt told NBC News “We do not have a copy of the course paper you requested and neither does Columbia University.”
The senator has not agreed to the release of his application to the Illinois state bar, which would clear up intermittent allegations that his application to the bar may have been inaccurate.
Jim Geraghty of the National Review has written extensively about Obama’s unwillingness to release records related to clients he represented while he was an attorney with the Chicago law firm of Davis, Miner, Barnhill, and Gallard. Obama was required to list his clients during his years in the Illinois senate. “Obama listed every client of the firm,” Geraghty reported, making it impossible to discern which clients he represented.
Obama has never released records from his time at Harvard Law School.
Obama also has not disclosed the names of small donors giving $200 or less to his campaign. An exception to the finance-reporting laws exempts the campaign from reporting those who donate less than $200, but that law never envisioned the more than $300 million that has been raised by Obama in small amounts. The Republican National Committee has released its small donors, as well as McCain’s, on a public database.
I find it dispicable that even some Democrats don’t feel that as a tax paying American citizen, they also don’t deserve to have these questions put to rest.
Sen. Barack Obama’s campaign says his campaign will bring a new level of honesty and transparency to the White House. Obama proudly touts that he and Sen. Tom Coburn, (Rep.) passed a law requiring more transparency via a public database of all federal spending.
But when it comes to offering the public documents about his own public and private activities, Obama’s record for openness gets an “F” grade.

All of us know what a REAL Birth Certificate looks like and it is NOT what is posted on the Obama sites. It would be very simple to post the real thing and end all the controversy. I do not doubt that he was born in Hawaii, but what is there to hide on the ORIGINAL birth certificate? My guess is that if he is not producing it there is a reason that he feels would negatively effect his chance of being elected. For a politician the election is everything. Birth certificates (like other official documents) vary from state to state. So there is no such thing as a universal “real” birth certificate, as you claim there is. Senator Obama’s birth certificate looks exactly like my son’s, which is an original from the State of Hawai’i. What’s posted on http://www.FightTheSmears.com is credible. Besides, if you don’t doubt that he was born in Hawai’i, then why is this even an issue? The veracity of John McCain and Sarah Palin’s claims regarding their own and Senator Obama’s records on the campaign trail are far more troubling - in particular, her failure to cooperate with a bipartisan (in fact, primarily Republican) panel in “Troopergate.” Talk about Bush-type deception all over again…
I recently talked to my cousin who is a stern Obama supporter. And her responses allowed me to understand how she and other obama-maniacs think: she said that she doesn’t care whether he was born here and whether or not he lied about it. Her exact words were “if he is right for the country and if the Constitution says that he has to be a citizen, then the Constitution is outdated and needs to be changed”. She said that even if he were proved to be a muslim, a follower of communist ideology, she’d still vote for him. Her hatred for Republicans (esp. GWB) is so great that she’ll vote for Louis Farakhan, if he ran on the democratic ticket (even though she is a Russian Jew).
Why prove who you are all the time. No one asked for his Birth Cert when he stood for Senate, got his passport etc. Why are they asking now?? So what if he was born elswhere but is an America. Can’t an American be born in the Serengeti or South Pole and still remain American????

The 20th amendment to the constitution, section 3, requires a president-elect to be qualified and specifies what happens if a president-elect fails to qualify - the vice president-elect (if qualified) becomes acting president until a president can qualify.
Hawaii’s Governor Lingle sealed the vault birth certificate because it was requested in Andy Martin’s lawsuit that it be sealed until his case is heard on November 7th. It’s sealed so no one can tamper with it or remove it. It’s basically being treated like criminal evidence in a police locker. Unless Obama authorizes a copy being made it’ll be introduced in a courtroom.
Someone asked how Obama could have gotten a U.S. passport. That’s easy enough. US senators are given a diplomatic passport. It automatically comes with the office. How Obama traveled outside the country prior to becoming a US senator is easy too. He used his Indonesian passport. He’s still a citizen of Indonesia. His passport records are also sealed. That too is evidence that will come out in a courtroom.
“Standing” becomes a non-issue if and when Obama becomes president-elect. The 20th amendment clearly gives every citizen a civil right to have a president-elect qualified (35 yrs old, 14 yrs a US resident, natural born citizen) before he can become president. Civil rights violations don’t require specific damage - deprivation of the right is damage in and of itself.
What I expect is going to happen is that this will quickly reach the USSC after the election if Obama wins. Discovery will be allowed, the evidence considered, and Obama will fail to qualify by a 5-4 split decision.
I believe that this would be such a huge embarrassment for everyone involved that they’re all silently hoping that McCain wins fair and square so this can quietly swept under the rug. Ane we’ll certainly see some new laws that require pre-qualification for presidential candidates in the future.
There can be no other outcome if Obama is not a natural born citizen. The United States cannot be seen ignoring its own constitution. The example that would set to constitutional democracies and aspiring democracies the world over is unacceptable. The U.S. is a nation of law and the constitution is the basis of that. Failing to follow the law is something that happens in banana republics not the world’s leading example of a democratic republic.
If anyone is wondering, here is section 3 of the 20th amendment:
Section 3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

But people who have an agenda have tried to make you think they do, & tried (quite effectively, it seems) to plant the seed of doubt in your head that if the candidate *doesn’t* do it, then he by-God MUST have something to hide, something so big that you shouldn’t trust him.

The simple way to prove that Obama was born in Hawaii would be to question the doctor who delivered him. Why has this doctor not spoken up?

It has to do with the fact that we as Americans (of all ethnic backgrounds) are required in a lot of instances to show our live birth certificate not a record of birth which he is passing off as official. I do not want to see a record of birth this proves nothing. By Hawaii and Kenya sealing his records this shows that he has something to hide. If not prove us wrong and asked your precious presidential elect to provide it. I dare you!

I’ve heard somewhere that all documents concerning Obama in Kenya have been sealed until after the election. You can’t call somebody a racist when they just want to get the facts straight. Obama’s cousin is currently the Prime Minister of Kenya and I’ve seen articles on the net about people accusing him of GENOCIDE. How many people do you know have been accused of genocide?

It is not difficult to produce a COLB forgery, like the one the Obama aids have perpetrated and claim it to be authentic. You’re not that naïve… or are you?

I couldn’t have argued the point better myself as I quote below from someone who has a lagitamate degree in law and not a clown like you who claims to have a working brain:

In the litigation business, one quickly learns that if somebody has a document that will be good for them, they can’t wait to give it to you. And if somebody has a document that will hurt them, they’ll be tap dancing faster than Richard Gere in Chicago to keep you from getting it.
Obama is tap dancing.
If I were Obama’s lawyers, and if there was a good, authentic, birth certificate that proved Barack Obama’s birth in Hawaii, I would tell him to instruct the Hawaiian Department of Health to provide a certified copy to every journalist who asked about it, to the Courts and plaintiffs in all the lawsuits, and to make the original available for inspection by any expert forensic document examiner any litigant or news agency engaged to examine the birth certificate for authenticity. I would tell him to come clean, and end the speculation. And I would tell him that the speculation could cost him the election.
But that’s not what Obama’s lawyers are doing, they’re filling motions for summary judgment, not on the merits of the case, but on “technicalities,” at least in the Berg case, arguing that Citizens, voters, do not have standing to enforce the United States Constitution, and at least one judge, Richard Barclay Surrick, has agreed.
But what Obama and his lawyers and the Democrat National Committee (DNC) are not doing is being open and honest with America. They’re tap dancing faster than Richard Gere in Chicago. So we are forced to this conclusion as a matter of logical necessity:
1. If Barack Obama could produce a good birth certificate that would verify his status as a “natural born citizen,” he would. Failing to do so can only hurt him. Failing to do so can cost him the election.
2. He hasn’t, and is doing all possible not to.
3. Therefore, we can only conclude that he can’t, and that his birth certificate, if it exists at all, is either altered, forged, or shows him born outside the U.S. We have to conclude that producing his birth certificate, if he can, will prove he is not eligible to be president, not a natural born citizen, or not a citizen at all. We can only conclude that Obama and his lawyers know that producing his birth records will hurt him even more than not producing them.
Now, I could be wrong. Barack Obama can prove me wrong by producing a good birth certificate. But he hasn’t. Will he? Can he?
PART TWO
NO “STANDING” TO SUE?
In the case of Berg v. Obama, US Federal Judge Richard Barclay Surrick agreed with Obama’s lawyers and ruled that Berg, as a citizen, as a voter, has no “standing” to enforce the United States Constitution. I have read that other agencies have asserted that only another presidential candidate has standing to sue respecting the qualifications of a candidate, presumably because, arguendo, only another presidential candidate could be injured (lose an election) as a result of a non-qualified candidate on the ballot.
This may be the most patently absurd, illogical, incomprehensible, astonishing, mind-boggling, and utterly stupid argument I have ever heard in my life – and from a Federal Judge, at that. And if I didn’t make myself perfectly clear, let me know and I’ll try again.
Let’s do the analysis.
1. The U.S. Constitution is a CONTRACT between The People, The States, and The United States, the federal government, that defines and limits the role of the federal government, and the rights of the States and The People, and, among other things, defines and limits the qualifications for president, i.e., that the president must be over the age of 35 years, and must be a natural born citizen.
2. Any party to a CONTRACT has standing to enforce it. This is as basic as it gets. Contract Law 101. First week of law school stuff. And it seems that lawyers and judges all over the country have forgotten all about it. Also, the Constitution was intended to benefit all American citizens, We, The People, and in basic contract law the intended beneficiaries of a CONTRACT, i.e., us, also have standing to enforce it.
3. If We, The People, do not have standing to enforce the CONTRACT, the U.S. Constitution, then it is unenforceable, and if it is unenforceable it is just a historic curiosity that means nothing. It’s just an old piece of parchment. But that was not the intent, and to give intent to the CONTRACT it must be enforceable by its parties and beneficiaries.
4. We, The People, have standing under the First Amendment “to petition the government for redress of grievances.” If we have a grievance that a non-citizen, illegal alien, is running for president, I think the First Amendment unequivocally gives every American citizen standing to sue the government to redress that grievance and enforce the Constitution.
I think Judge Richard Barclay Surrick is dead wrong, illogically wrong, irrationally wrong, legally wrong, I think his legal analysis of this issue, in legalese, stinks.
PART THREE
THE DUTY OF CONGRESS
Article II, Section 1, requires that upon taking office the President of the United States shall take the following oath:
“I do solemnly swear (or affirm) that I will faithfully execute the Office of the President of the
United States, and will to the best of my Ability, preserve, protect and defend the Constitution
of the United States.”
Article VI, Clause 3, requires that Senators and Representatives requires:
“The Senators and Representatives before mentioned, and the members of the several state legislatures, and all executive and judicial officers, both of the United States and of the several states, shall be bound by oath or affirmation, to support this Constitution . . .”
Members of Congress take this oath:
“I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservations or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”
Having taken this oath, Sen. Barack Obama has violated his oath of office if he is refusing to disclose a birth certificate that proves his candidacy for president is unconstitutional, and I believe this is a mandatory basis for his impeachment.
Having taken these oaths, the President, the Vice President (an executive officer of the United States), every member of the Senate and House, every member of every State legislature, and every executive and judicial officers of the United States and of each State, has a mandatory duty per Article VI Clause 3 of the US Constitution to “support and defend” the Constitution, and that would necessarily include taking whatever action is necessary to assure that no person who does not meet the Constitutional requirement of “natural born citizen” ever becomes President.
And every Federal Judge, and every Justice of the Supreme Court, having taken this oath, also have a mandatory duty to “protect and defend” the Constitution by doing whatever is necessary to assure that no person who does not meet the Constitutional requirement of “natural born citizen” ever becomes President. Indeed, I believe that the Supreme Court has a sua sponte duty to resolve this dispute by ordering, on its own initiative, the immediate production of all of Obama’s birth records in order to confirm his place of birth, and prevent the election of an UnConstitutional President. So far, all Justices of the Supreme Court have failed this mandatory duty.
So far, the President, the Vice President, every member of Congress, Democrats and Republicans alike, ever Federal Judge and Justice, every member of every State legislature, and every governor, have failed in this duty. They have all failed to fulfill their oaths of office. Every one. They must all demand that Sen. Barack Obama either (a) produce a good birth certificate proving his status as a “natural born citizen,” or (b) withdraw his candidacy before November 4th.
All those who do not should be impeached for having failed their oath of office.
PART FOUR
THE GREATEST SWINDLE IN HISTORY
If Senator Barack Hussein Obama cannot prove that he is a “natural born citizen,” then Obama, the Democrat National Committee, the Democrats in the Senate and House who support him, and others such as former president Bill Clinton who openly support him, have perpetrated the greatest swindle in history by falsely and fraudulently misrepresenting Obama as Constitutionally eligible to be president, concealing the truth about his place of birth, thereby inducing millions of Democrats by the fraud of concealment, by the lie of non-disclosure, by “trick and device,” to invest hundreds of millions of dollars in the Barack Obama presidential campaign to elect an UnConstitutional President.
My opinion.
Note, this is a fraud perpetrated by Sen. Barack Obama, the DNC, and hundreds of Democrats in Congress, on their own constituency, the Democrat voters of America. It is a fraud of the Democrats, by the Democrats, and perpetrated on the Democrats. And it has defrauded Democrats out of more than $600 million.
According to their oaths of office, every Democrat member of Congress has an affirmative duty to assure that their presidential candidate is constitutionally qualified. As soon as questions about Obama’s birth arose, every Democrat in Congress had a mandatory duty to confirm his eligibility by demanding release of his birth records. But, they have not. Not to my knowledge. Instead, every Democrat in Congress is complicit in the cover up – the cover up – of Obama’s birth certificate, by failing to demand full disclosure to confirm his place of birth.
In my opinion, unless Obama can produce a good birth certificate proving that he is a “natural born citizen,” then every Democrat member of Congress, every person managing Obama’s campaign, every officer and director of the Democrat National Commitee, and every person who has ever taken an oath to “support and defend” the Constitution and is now supporting an UnConstitutional candidate for president, has participated in a vast left-wing conspiracy to defraud millions of Democrats out of hundreds of millions of dollars to elect an UnConstitutional President.
In my opinion, every one of these people, hundreds of them, should be prosecuted for fraud under the Racketeering Influenced and Corrupt Organizations Act (RICO), for if Obama is not a “natural born citizen,” that is what the Democrat National Committee (DNC) has become. And every one of them should be tried, convicted, and sent to prison for decades, for this is a $600 billion swindle of America’s Democrats, a swindle perpetrated by the DNC and Barack Obama.
Now, I could be wrong. I could be wrong about every opinion I have expressed here.
Sen. Barack Hussein Obama can prove me wrong, quickly, simply, easily, by opening the doors of the hospitals and the Hawaiian Department of Health and showing us, showing America, showing the Democrats, all of his birth records.
Unless and until he does, I will remain convinced that Barack Hussein Obama is not an American citizen.

WHAT AM I MISSING HERE ???
WHY IS THIS BEING DISMISSED? How can Obama take part in a US presidential election running to be our Commander In Chief, with access to our nuclear arsenal, and not be a proven United States Citizen??? You cannot even get a driver’s license without producing a legal birth certificate. Who is in charge of this? Someone in government has to be serious about this. It is in our constitution, so who is enforcing it? We are going to be the laughing stock of the whole world by even letting it get this far. I am certain that this guy is NOT A CITIZEN otherwise he would have provided this document freely. He probably went to visit granny so he could make sure he destroyed the birth certificate she had in her possession.
Please tell your listeners WHY this is not being addressed by someone in government?

There’s a very old saying: It ain’t brag if you can back it up. I’d be quite willing to put my next 3 paychecks against anything you could pony up, that Berg’s laughable “appeal” to the Supreme Court to stay the election won’t even get a hearing. He swore blind he would have it filed at the Supreme Court today, yet there is no record whatsoever of it ANYwhere on the USSC website.

I am saddened that our country is unable to get the most important paper that we all own out of Barack Obama. I really don’t trust him at this point since not showing this means he doesn’t have one and most likely is not Natural born which in effect means he is going against our constitution. Spitting in our faces and laughing the whole time. If he is lying about this, what else is he lying about? Look at all the awful people he associates with. Do I think he is the enemy from within? Absolutely and I should not be fearing this for my country, myself or my children, but I do.
The worst thing about it is the media bias in not reporting this and making it an issue of national security. It seems money talks and he knows he can just buy his way through and ignore our laws since he probably knows them better than all of us. What a smug man! I hope that what I fear is not true for all of us. I can only cast my vote for McCain and pray that we all see him for what he is.
Just a note: I would love for him to prove me wrong and just submit the damn vaulted certificate to the Supreme Court or authority that can be trusted. Trust is running thin with me. He has lied about too many things in his campaign to be trusted to his word.

The problem is that Obama refuses to produce the “vault” certificate which is the document which the state uses to issue the certificate. The vault certificate shows the doctor, hospital etc.
Obama has refused to release this “vault” certificate and that is the document that has been sealed by the governor of Hawaii.
There must be a reason. From 1911 to l972, Hawaii permitted a person over the age of one to obtain a birth certificate by submitting an affidavit from the mother that the child was born at home. Thus Obama’ls mother could have obtained a birth certificate for Obama - thereby ensuring he was an american citizen. Obamas Kenyan grandmother says he was born in Kenya… Obama may be ineligable to be president if he was not born in the US. That what makes Obama refusal so puzzling — if he does’t produce the vault certificate - it leads to endless speculation that he has something to hide..
Taking Obama’s word that the document actually exists, I can think of only one possibility to explain his refusal to publicize his birth certificate:
The document must contain information embarrassing to him.
Could it possibly identify his religion as Islam? Or his race as Caucasian?
