Jose Baez likely should have stuck to ambulance chasing, he clearly is not ready for prime time. With his ‘talking head’ Todd Black opening his mouth and solidly sticking his foot in it over the ‘dead child’ comment, what else can go wrong?
Who Knows? But what we can do is examine how Jose Baez has operated in the past. He is not comfortable in the courtroom, he much prefers for cases to dissipate into thin air. He has only had one chance at defending a murder case, and guess what? He lost it. This is hardly a stellar resume, but of course it could be argued that ‘killers can’t be choosers’, well I think that is the saying.
Most of the legal pundits have picked up on the fact that Jose Baez missed an obvious chess move at the arraignment hearing. Rule number one when you are defense is to forward a motion for a speedy trial. Oh, don’t get me wrong, speedy is a misnomer, but it does move the case forward from the glacial speed that the prosecutors would prefer, the more time they have, the more evidence they can amass. The speedy trial motion forces the prosecution to move at a speed more approaching that of a garden snail moving from baby lettuce plant to baby lettuce plant.
It is in the defenses interest to do what they can to rush the case to a jury as soon as possible. This limits the ability of the prosecution to acquire more ‘fire power’. Jose ‘hot shot’ Baez seems to have forgotten ‘Defense lawyering 101′, he failed to ask for this fundamental right. As it now stands, and I personally have no problems with it, the prosecutors can take their time to find new evidence, and build their case.
The question becomes, one of how much longer can Baez hang in there? Of course from Casey Anthony’s userous perspective, all of this plays right into her hand. Regardless of how guilty the jury finds her, Baez has provided a wealth of ‘get out of jail free cards’. What should be realized though, is that this is not a game of Monopoly, this is about a missing, and presumed dead 3 three year old.
I can understand the police wanting to make sure that they have every scrap of damning evidence, but I also think there is a basic need to bring this sad case to an end. I am not a proponent of the death penalty, and years ago, in England voted for its removal as a form of punishment. I still have that belief.
The ‘eye for an eye’ biblical’ punishment style has no place in our modern world. However I will make the exception for some monster that would kill her own child!

Spokesman Says Baez Has Assembled Team Of Experts To Assist

ORLANDO, Fla. — WESH 2 News has learned that Casey Anthony’s lawyer, Jose Baez, is not qualified to represent his client in a capital murder case.
Within 175 days from her indictment, by Florida law, prosecutors have to try Anthony for first-degree murder.
Anthony’s daughter, Caylee, was reported missing in mid-July.
The state has strict guidelines for who can and can not represent a capital murder defendant. Legal expert William Shaeffer said Baez does not qualify.
He’s not been a member of the Florida bar for five years, criminal procedure,” Shaeffer said.
According to his spokesman, Baez is well aware of this policy and has assembled a team of legal experts to assist him including an attorney qualified to try a death case.
If there is a conviction, Shaeffer said by law it would be up to the jury to recommend a death sentence or life.
“It’s highly unlikely a jury recommends life. A judge will come back and give her death,” Shaeffer said.
Since Caylee’s body has not been found, the state attorney is relying on circumstantial and what he called “cutting edge” forensic evidence.
“This prosecutor’s office brought the first successful use of DNA to the American criminal courtroom. We’re used to complex evidence and we’re prepared to manage the scientific evidence in this case,” Lawson Lamar said.
Young Mother Offered No Information To Investigators After 4th Arrest

According to a source who spoke with her, Anthony did not offer any new information on her daughter Caylee’s whereabouts. Anthony had requested court approval to travel to places of interest in private with her attorney to prepare her case, but on Wednesday, those motions were ruled moot since she was charged with first-degree murder. (The judge has not ruled on another motion to preserve DNA evidence.)
After the grand jury’s indictment was handed up, an investigator said they were waiting for Judge Perry to issue an arrest order, which he did.
That meant intercepting Anthony after she’d gotten out of her mother’s car on state Road 417 and gotten in with her bail bondsman. He intended to take her back to jail.
Bottom line, that investigator said, they wanted to send a message about who was driving the investigation.
The notion of Anthony being allowed to turn herself in on premeditated murder charge was not an acceptable option.
In a fax, a spokesman for Baez called Anthony’s rearrest show-boating and a sham.
What’s next for Anthony could last several weeks.
Both sides are now gearing up for a trial. The state has 175 days to put Anthony on trial for murder.
If Caylee’s body is never recovered, long-time Orlando defense attorney and prosecutor William Shaeffer said it will be harder to convict or get a death sentence.
“You’re going to have a hard time convincing citizens she should give up her life even if they do believe she committed some level of homicide,” he said.
The state accuses Anthony of failing to provide adequate care for Caylee leading to her death, but the indictment does not give a specific theory of how the child died.
But obviously, one investigator said, evidence of chloroform in the car and Anthony’s suspected computer searches on the solvent will be key in prosecutor’s argument that this was premeditated murder.
Currently, Anthony is at the Orange County Jail in protective custody — meaning she can see other inmates but can’t talk to them.
She spends the better part of 23 hours of the day in her cell with no access to television.
She can request the use of a radio and it’s up to the staff if they want to let her use one.
Anthony has one hour a day to shower, make monitored outgoing phone calls, and spend time outside in the recreation yard depending on Weather and jail staff.
Will Baez Continue As Anthony’s Attorney?
Since Casey Anthony’s murder indictment, questions have been raised as to whether Jose Baez will remain her attorney.
According to Baez’ representative, Todd Black, he will remain on the case to represent Casey Anthony in the murder charge.
Black said right now the case has not been declared a capital murder trial, and said Baez has been preparing for this possible scenario by building a team of attorneys, including one who handles capital murder.
BB (Jose’ Baez) needs to take his own advice and stay silent.
I personally want a good legal defense — with at least one seasoned attorney who has many capital cases under his belts — in place before this goes to trial.
If not, then there will be so many appeals and cries of inadequate representation that she may get out of this.
I would say maybe that’s what BB is planning all along–but no…he’s really as stupid as he has been acting.
Will she get the death penalty? Probably not.
First-degree murder is punishable by death, but the history of female killers executed in Florida during the past 150 years is brief.
The state has executed only two women in the modern era. The third, a slave who killed her master, was hanged in the mid-19th century.
Of the nearly 390 people on Florida’s death row, only one is a woman.
Leonard Birdsong, an associate professor at Barry University School of Law in Orlando, said women are rarely sentenced to death. And he does not think Anthony, who was indicted Tuesday in the disappearance of her daughter, Caylee Marie, is a good candidate.
The young single mother has no prior criminal history, is not an obvious predator and has made no known confession, he said. He also suspects Anthony could have psychological issues.
“If I were a prosecutor, this probably would not be the case I would seek the death penalty,” Birdsong said.
Only 1.5 percent of death-row inmates nationally are women, said Richard Dieter, executive director of the nonprofit Death Penalty Information Center. But most of those 51 women killed someone they know: a husband, boyfriend or their own child, he said.
The decision to seek the death penalty often is tied to politics and community outrage rather than the heinousness of the homicide, Dieter said.
Even so, though the Anthony case is the kind of crime that shocks the public, “many women have killed their children and don’t get the death penalty,” he said.
Randy Means, spokesman for State Attorney Lawson Lamar, said Wednesday that he could not discuss prosecutors’ plans for Anthony. But he did say they will make a decision in the next few weeks.
hopefully Baez doesn’t do something so that she can get off by any legal misrepresentation on his part, also hopefully they will have found Caylee’s body by then or evidence of one.

I haven’t reviewed Baez’s stellar resume. It goes without saying he probably didn’t anticipate being compared to Cochran and the other greats associated with Mark Fur….whatever. I’m not too familiar with legal plays either, though I found the snail analogy quite humorous, as any novice gardener would. Perhaps you meant ‘beggars can’t be choosers’ since this case is done pro bono…unless I am confused and someone meant Sonny Bono. (I’m blonde).
I agree with you that this isn’t a monopoly game; however, it was Padilla that started the ‘get out of jail free’ cards. Perhaps he was hoping to get to Boardwalk and ‘cash in’. So far it’s just the Nancy Grace show…what a let down. Actually, after reviewing some of the footage I can’t help but wonder why Casey should have to stand trial at all, or better yet, why do they even build court houses? Isn’t that a waste of funding?

I heard Todd Black’s telephone interview with Mike Galano on CNN Headline News, and he DID make the comment as reported by Headline News. In fact, I was SO shocked when I heard his comment, I tried to call Headline News’ 888 number to make sure I had heard what I thought I had. I also wondered what he may have heard about the evidence presented at the grand jury hearing which convinced him of Caylee’s demise.
Then, Black and Baez only made it worse with their numerous attempts at damage control. First, they said the comment was “edited.” Then, they said it was “misrepresented.” Then, they said he did make that comment, but was only “quoting” what a prior commentator had said while responding to that commentator. Fianlly, Baez said the comments were taken “out of context.” Let me assure you, CNN is correct - I, along with a million other viewers, heard those exact words out of Mr. Black’s - and in the context CNN is presenting them. Mr. Black was NOT playing off a previous commentors remarks. In fact, he started his remarks with a rather sarcastic harangue against Mr. Galano. What I think happened was that Mr. Black lost his temper during Mr. Galano’s questions/comments and the comments of the other guests and the audience was treated to a “Freudian slip” by Mr. Black. I believe we actually heard his true feelings regarding Caylee.

Evidently they are complaining to the landowners of people who let them set up the booth on their property. I think that is wrong. He has as much right to his opinion as we have to ours. I believe he feels he has no choice but to believe she is alive. He does also say that she is involved in somethng… take time to sort it out. They haved learned that they have power. Regardless of M’s guilt they haave a right to search and who knows maybe someone seeing the picture might remember something. Not to find a live Caylee IMO, but that could help locate her body. There are so many people coming forward now. Just like the one yesterday with the guy who saw her in a straw hat and sunglasses. Not all evidence is released to the public until the trial is over. Not all discovery makes it into the trial. The state and the defense have a session on what should come in and what doesn’t come in to the trial. If necessary a judge is called in to decide if the discovery is brought in or omitted from the trial.

Judge Strickland denied all BB’s motions that were tabled. Testing will proceed by the state that was the big one.

I am not taking up for M, whether M confesses or not, any many of us have secrets that we will never confess to man, our sins will find us out eventually. Dak - There are thousands of missing children and persons. Their photos are out there. If any are seen they can be reported to the police, to a missing children’s organization, to lots of places that will help. I think it’s a stupid waste of time and money to have a specific tip line open 24/7 FOR YEARS for EVERY SINGLE missing child or adult.
If a person spots someone they think is missing there are plenty of places to go to call to email etc to get the word to people who can take it from there.

Belgian Children to be given electronic identity cards
Electronic identity cards for all children under 12 are to be introduced in Belgium. They will bear a code designed to allow parents of missing children to be traced instantly.
