On Friday, the FBI arrested a former Countrywide employee and his accomplice for stealing and selling personal information (including social security numbers) obtained from people applying for mortgages. According to news sources, the number of people compromised was about 2 million.
The Countrywide inside man was identified as Rene L. Rebollo Jr., who worked at Countrywide’s sub prime lending division, Full Spectrum Lending. Also arrested was Wahid Siddiqi, who was the alleged information reseller in the caper. Both arrests took place in Southern California.
The criminal complaint alleges that Rebollo downloaded 20,000 names a week for about two years. The batches of 20,000 were sold for about $500 to Siddiqi. This amounts to about 25 cents a person compromised.
According to a spokeswoman at Countrywide, the investigation shows that 19,000 peoples information has been actually used.
Beth Givens, of the Privacy Rights Clearing House was quoted in a story about this in the LA Times and aptly pointed out Rebollo sold the information at well below known black market prices. Although the prices for stolen information — which is sometimes sold in underground Internet forums has dropped in recent years — a name that has a matching social security number is worth well more than 25 cents a pop.
The official spin is that this information was used for leads to sell real estate, but my speculation is that how would anyone know for sure? According to the news reports, the information was being sold to companies. The FBI posing as a company was able to buy records for Siddiqi.
If it was sold to companies, who knows who they might have sold it to, or if they have any dishonest employees selling it, elsewhere?
This made me wonder if any of the companies buying the information will be publicly disclosed? In a similar case at Certegy — where another dishonest employee was caught and convicted for selling stolen information to “companies” — the companies involved were never made public or charged with any crime (to my knowledge). Court records indicated a co-conspirator in this case, but again (to my knowledge) no one has ever revealed exactly who this mysterious co-conspirator was?
Givens also pointed out that names, which include a social security number and perhaps financial data, can be used to commit what is known as new account fraud. New account fraud is where an identity thief poses as their victim and opens new lines of credit. Once this is done the first time, the thief (sometimes thieves) continue to open lines of credit until the victim’s credit report makes them look like a deadbeat.
My guess is that the affected people will be offered some sort of credit monitoring/identity theft protection. While this prevents some forms of identity theft, it doesn’t necessarily protect from all the ways a stolen identity can be used. Some examples of when it might not show up on a credit report are cases of medical benefit fraud, employment fraud, government benefit fraud, some forms of check fraud and last, but not least, when it is used to commit crimes of other than a financial nature.
Recently, the Privacy Rights Clearinghouse, issued a well written fact sheet pointing out that existing credit monitoring/identity theft protection services do not protect a person from all forms of identity theft. I highly recommend that anyone — who thinks their identity has been compromised — read this fact sheet before buying or relying on the free protection offered in the aftermath of a known data compromise.
If and when — employers are required to react to workers using social security numbers that do not match — the millions of illegal immigrants already over here are going to have to use real social security numbers and a matching name to remain employed, or obtain employment. While the federal law on this has been tied up in federal court, some States have already enacted similar legislation. This type of identity theft normally doesn’t appear on a credit report and is often discovered when a person files their tax return, or gets their social security earning statement and notices employment listed they never had.
A statistic that might support this is the IRS revealing that identity theft used to file tax returns has grown 644 percent in recent years. The two main reasons cited for this were people using them to obtain employment or to file a fraudulent tax return to obtain a phony refund, normally using what is known as the earned income credit.
Stories of large scale data breaches seem to surface, frequently. Despite this, there are a lot more that no one ever finds out about. Recent evidence revealed by Finjan, a computer security outfit, supports the contention that we really don’t know how much stolen information there is out there, or how it is being used. Finjan has been discovering what they term as crime servers on the Internet, which contain all kinds of stolen information. This information included compromised patient data, bank customer data and even sensitive e-mail communications. At least some of this information wasn’t even password protected on the crime server.
This particular data breach at Countrywide will probably fade into the mist fairly quickly. It does show that any and all security measures can and will be defeated when a person who has access is the point of compromise. The sad fact is that despite a lot of efforts — until the issues that fuel (enable) this problem are addressed — we will continue to see personal and financial information stolen.
We have made personal and financial information worth a lot of money and there are a lot of people buying and selling it. Some of them even have legitimate or semi-legitimate status. The more this occurs means the information is going to be electronically transmitted (sold) and then stored in a lot of different places. As long as this keeps happening, it’s probably impossible to protect all of it.

I really wonder if this is just the one that got caught. If Countrywide’s security is so lax that an employee can download that many records over that long a period of time without some type of security flag going up, you have to wonder if that kind of activity is still going on.
I really think, given the size of Countrywide and the number of people that could potentially be impacted, a federal investigation into their security practices is in order.

My husband and I have been so careful all our lives with our credit information and now to have this happen. I feel violated and betrayed. I want to know that this person will be prosecuted. I want some assurance that better security systems regarding their employees is put in place.
I can’t rest wondering if someone is using my information against me. I want someone to pay for the emotional stress of this situation.
Any law firms covering this please post your contact information as Country wide has offered a pittance to cover their mistake. Two years of free credit reporting by one of their own clients (free to them). Meanwhile they have destroyed our lives. I want them liable for at least 7 years of credit history reporting and financially liable for any damages and cost to repair my history.

I just found out about this and I am very upset. Why did we just receive a letter today when this was uncovered in July. They should have notified us the minute they found out. If anyone finds out any information on a class action suit please post it here. Something needs to be done besides their offer of 2 years of free credit reporting. I now have a suspicion of why i started receiving a 9.99 charge on my checking account and why I could never get a response from the company that was charging me. For everyone reading this please keep a close eye on you checking and saving accounts because this information was also in your file!!
My thoughts exactly!!! Why am I just now receiving this letter???!!! This is sickening news! It is saddening because I don’t want to feel that no one can be trusted, but it never even occurred to me to worry about someone inside such an institution stealing this information and selling it to others. This is so disheartening. I agree with others comments regarding the trivial gesture of offering 2 years free credit monitoring. What about the emotional stress and worry this is putting on people wondering when or if they are going to have their personal information used in such a way as to seriously impact their lives in a negative manner? This is extremely upsetting!
I received my letter lastnight. To late…..I have already had one of my bank accounts wiped out. Had I known in July, this could have been prevented. Lucky for me my bank is looking out for me.
Can we sue? The way house values are today, I owe more than my house is worth. Countrywide should buy my house off of me. That will satisfy me, or pay me $150k .. “sorry but an employee that represents countrywide mortgage has just sold you to a criminal that steals identities,.. again sorry” No, No, No.. not that easy your gonna pay.

The more I read on this the more furious I get Two years of credit reports is a cop out and I really hope no one is satisfied with this. I’ve only lost $20.00 to date but there is no way of telling what other damage has been done. Countrywide wants us to believe that he only sold the information to other mortgage companys that is BS. It will take me longer to explain to companies about the problem when I get denied for a loan. They need to take ownership of the issue. Because our lives will be turned upside down. Lets fight.

I also contacted the Countrywide hotline which was not helpfull at all they said the only thing we can do is moniter our credit reports. So i guess their theory is catch it after it happens. Countrywide was less than helpful. In fact that told me that was all I was getting and too bad.
This was after getting the run around for over two hours. I am still pursuing this.
I want them to be responsible for any fees incurred to fix my credit history for the next 7 years or the life of my loan, whichever is longer. I will also be inquiring to see if I can put my mortgage in escrow until this is properly resolved.
What factors must be present to start a class action lawsuit?
There are several requirements to consider when attempting to form a new class action case. Simplified, these are:
Numerosity - adequate number of plaintiffs
Commonality - common damages and legal issues
Typicality - each class member’s claim must come from the same event, and must make the same legal argument
Adequacy of Representation - the representative plaintiff will adequately protect and represent the interest of the class
Viability of Defendant - although it is not a requirement of the court, it is reasonable to assume that if the accused does not have the means to compensate for the alleged damages and legal costs, it would be difficult to entice a law firm to represent the class.

We received the Countrywide letter today. As of now, we haven’t been financially compromised, but will check out our credit reports just in case…but how many of you have been victimised directly from Countrywide’s criminals? How? Have to say it we have only had a couple charges that we could not verify from a company that i could not find anything about I was lucky enough to catch and get it stopped after 2 months and it was a small $9.99 charge. If you read the post from upset they had their account wiped out. One thing that crountry is not saying is our checking account numbers are on those records they require that information on their applications. I would watch every charge coming in on your account. I have started writing down when where and how much everytime I use my debit card to make checking bank activity easier.

I just got my notification today and I am, to say the least, pissed off! Countrywide seems to think that offering us “free of charge” a 24-month credit monitoring service for this “inconvenience” is going to take care of all the problems their employee has caused to a great many customers. I just recently refinanced my home with another lender at the end of August, and now this! There should be financial compensation for all of the extra crap we have to go through now that takes away from our daily routines. Plus there are all of the fraudulant escapades going on that we will never hear about. I can’t believe that this has been going on for two years and Countrywide never even knew it. No wonder they are in such financial turmoil. I, too, smell a class-action lawsuit. I would like to know if there are any lawyers who are going to involve themselves with this. WOW!! I just found this out because I work in the Identity Theft field helping to educate people and businesses on this kind of crap and so I get the news when it first comes out on any Identity Theft that happens out there! I have to say that we are also customers of Country Wide, and we have not gotten a letter yet, but we are pissed as well!! I know working in the Identity Theft field that we all do need to file a class action lawsuit. Our SSN’s are the heart of our entire identity and these idiots have it and are running around with it, doing what they please with it, and probably selling it!! Seriously people, how would the people who run Country Wide like it if this happened to them, I darn sure bet that they would have the means to have it taken care of right away, they would take care of themselves, well why not take care of the customers that build and support your business then!!!!I have a couple law firms that I am calling first thing tomorrow, I will definately keep you all posted if they will take the case!!!!
There needs to a federal law that penalizes company’s for any breach of security where identify theft occurs. The penalties need to be so strong that companies start taking this issue seriously. There is no incentive for corporate America to prevent it from happening while the cost to clean up the mess is less than the cost to prevent it.

Has anyone that sent an email to kamber edelson heard back from them. I do not want to sign up for the free 2 years of credit report that countrywide is offering untill i speak with someone because i am afraid that i will waive my rights somehow to sue. We are going down today to notify the bank and I’m also calling the police station here to see what they think I should do. Countrywide told my husband that there was no need to file a police report. I don’t know about everyone here but I don’t want to get pulled over for speeding and end up going to jail for what someone else may have done. I also have another question since the man that stole the information is only going to get 5 years for the crime is it possible for every one of us to file individual charges on him so he either spends the rest of his life in court or does alot more time.

dgarrrett do a search for classaction suits on countrywide there are some states that are sueing them for the loan types much like yours. It would be worth looking for you may get some relief that way also. I also read that countrywide is offering to refinance some of these loans but i’m not sure if i would trust them anymore. If i was in a position to go somewhere else I would in a heartbeat.
We just got this letter today!!!!!!! I am sickened! September 11th! And this happened when? We also through the summer had strange activity with our bank accounts too. This is more than disturbing its frightening to the security of our family! Our families lively hoods are now at a very severe risk.

We have no choice but to stay in the position we are in because we played the refinance game got screwed. Closing cost over and over and bait and switch when it came to signing. Were tired of it all and we work hard for what we have. and this is what we end up with.
I remember back in the 80’s a mortgage company that got caught for inside deals ( gave people they knew who couldn’t afford the loans anyway so they could flip houses for a profit and others were denied)that hurt so many people and some of the attorneys who received closings from that bank were also involved so be careful choosing an attorney and that they have no association to that Company. The banks and the attorneys all work together and trust me I know the Realtors sometimes do to.
I know of one close to home where the owner of an insurance company and real Estate company told my friend to sell the house to this woman even though he knew she would loose it. My friend walked out. They are ruthless and all work together.
Yes I’m also for each one of us affected that it be reasonable to have an individual lawsuit also against that guy. 5 years! Another BS.

I got this letter last night, I was pissed, then I found the names of the 2 jerk-offs who did this, Rene Rebollo Jr. and Wahid Siddiqi. Both from LA area. And then I read that they confessed tothe FBI of doing these acts, but then plead NOT GUILTY in court!?!?!? How does that work!?!?!?!?
They are set to be in trial Oct 7 and Oct 14th. his is the problem with the justice system…. Oh and Rebollo is out free on an $80,000 bond!!!

I had an incident on credit 2 months ago, I applied for credit and got turned down because of something on my credit report-I always had good credit.

I also received the letter today. I had no idea. I am under the impression that one of the companies that bought personal information from this individuals was US Homeowners Assistance located in California. They called me out of the blue and said they work with Countrywide all the time and that they could get them to lower my principal and interest for a fee of $2500.00. They said since I was going through hardships, that they will lower their fee to $900.00. To make a story short they took my money and did not do anything. Now we are in foreclosure and are doing a short sale.
These are the steps that I am taking so far
1. Changing all bank accounts
2. making rest of house payment through money orders so countrywide never again has my account numbers
3. freezing my credit so NO loans or credit cards can be obtained for the next 6 months
4. contacting the ssi office to see what can be done on their end
5. checking to see if i can file a police report incase someone steals identity and commits crimes under mine or husbands name
6. NOT ACCEPTING THE 2 FREE YEARS OF CREDIT REPORTS THAT COUNTRYWIDE IS OFFERING. I will pay for a yearly service on my own through another company that is not affiliated in anyway with countrywide.
7. WILL NOT DISCUSS ANY DISCREPENCIES IN CREDIT REPORT WITH COUNTRYWIDE WILL TAKE TO LAWYER OR LOCAL OR FEDERAL AUTHORITIES.
I am cutting all contact off with countrywide unless there is a problem with a payment. I am not giving them any information that may help them cover anything up or be able to dispute any of our claims.

There is not a minute that goes by that this has not been on my mind to the point it is making me physicall ill. I have gotten very little sleep I’m either crying cause I just don’t know what to do or I am extremely angry that they could let this happen. Went to the local police yesterday and they laughed saying that i could not file a police report. Then called the state police and the atty general and was told by both of them that i was pretty much on my own. Also called the FTC and they told me that they dont help the consumer but i could file a compliant if i wanted to. I told her to go f*^k herself!
I ended up putting a freeze on my credit reports yesterday. My bank told me there was nothing i could do until fraud was committed.
This system is a joke. Also emailed that law firm above but have not heard from them.

I sent an enquiry to the law firm that was recommended (KamberEdelson) and have yet to get a response….I smell something fishy and won’t continue with them until I hear something concrete from a majority of you all.
But as a victim of a prior identity theft in the late 80’s, I can tell you, yes, it’s a major pain in the ass but not impossible to deal with. After all was said and done, it took awhile to clear everything up, but I didn’t lose any money. Vigilance is the key, monitor your checking and savings accounts, your credit card charges, and get your credit reports from all 3 agencies. (It’s amazing what mistakes the credit agencies can make on their own!) If we get any bill from credit cards fradulently opened in our names, I’ll just report it to the police and credit company. I’m not legally required to pay any credit bill I didn’t personally sign up for. Nobody’s getting a dime from us illgally, and I’m not trusting some hinky credit monitoring agency to do my work for me. It sucks that we have been put in this situation in the first place, I totally understand the anger, especially since I have to go round with this yet again. But this crap can happen anywhere, anytime, no matter how secure these companies say they are. Don’t lose sleep over it, people. Been there, dealt with it, survived much smarter. It’ll be okay. Hopefully we’ll organise a CA suit, but I doubt we’ll get much more than the lame 2 year monitoring program they’ve already offered.

I got my letter a few days ago. I am a single women and raising my infant grandson. What a rip off. I work hard and struggled to get my home. I’m not about to have someone take everything I’ve worked for and put me in the poor house. The company should do criminal background checks on their employees. I for one will be joining a class action suit if it comes available. I am so discouraged by this. A person with a great job has to stoop to this level for just a little more money than his already overpaid salary and who pays? the people that trusted them. It is so sad.
Well my husband is thinking bankruptcy and doesn’t care anymore at this time. They can lock me up for a crime I didn’t commit he says because he’s done for. We went through the refinance thing numerous times to stay afloat he works two jobs and he makes a decent income. But gas has gone up, food has gone up taxes have gone up. We don’t have any pleasures really.

I am scared for our future. Its hard to save. we live pay check to pay check. The utility bill is sky high even though we live in a small ranch and i go around trying to shut things off to save money and he works for an energy conservation company.
Were one year shy of 50 and can’t believe this is where we r but we are. I lost my sister 4 years ago I remember she had been getting calls from mortgage brokers and they became her best friend. She wasn’t well then and was really talking to them like they were her best friend. My mother finally overheard one of these conversations and grabbed the phone and told them to never call her daughter again.
She had been refinancing and refinancing to pay for her daughters wedding, she took trips and always said she wanted to do this before she passed away. We never thought that would happen.
She was a school teacher a wonderful mother and her husband worked for the gas company. Working out in the cold or heat so others could be comfortable and safe. But in the end she couldn’t take it anymore. The preyed upon her and took advantage of her. Her husband didn’t take care of the bills she was left with it and really shouldn’t have. I’m not saying she wasn’t responsible for her financial situation but they kept calling and calling and she would think it was a way out but drove her deeper into debt and she lost it. She didn’t commit suicide but was emotional a wreck from it all like I am right now. And her health failed and she passed out in my parents pool and drowned.
To this day i think back on her sitting at her kitchen table on the phone with all her bills spread out and watching her on the phone and seeing how she juggled all her finances but it only drove her deeper into debt. This is happening to us and we only had to only refinance because of certain circumstances like the bait and switch terms of a loan when you went to sing and found out u had either a loan that only paid interest for not sure how many years that was an adjustable rate and being told if you don’t sign we could loose the loan and the rates would go up and we would loose out home.
Right before the rates skyrocketed I refinanced I had to or our mortgage for this tiny little save haven we have would have been lost and this is how we got in with countrywide. This is the third time our loan has been bought since that last refinance three years ago.. Which is now countrywide. My husband said he had no other choice but to allow it. This buying and selling of loans puts us the consumers at risk and we have no way of controlling it. We are not secure.
Im just scared now. Yes I do feel like a victim. But like another person on here said the police and all the others said there is nothing you can do. Well isn’t that just great.
We even to protect ourselves as far as mail goes got a post office box because with a mailbox outside on the street your open to people going through the mail and taking what they want. We try and make sure whatever goes in the trash with any information gets diced up. And we live out in the country nice place but $#it happens.
Back in the 80’s while living in a condo i witnessed the goes one of dumpster dumping. I actually have photos of the man taking trash bags he filled from the ones he tore open to take documents people had thrown out. So watch your trash.
Well sorry to have said to much. This one has really sent my husband over the edge and I’m now concerned. I know I could find help somehow through family but that’s last resort.
This country is going down the tubes and its run by criminals. how many times r u sitting there watching the news and you find out another high official has been caught up in some kind of scandal but they get off most times.
I don’t trust anyone any more and am ready to bail myself but can’t because I have a child who needs me and I will keep it going as long as I can. I can’t leave her alone so I am a stay at home mother while my husband works two jobs.
We may have to bring in a third job. I think out total income is around 80K a year give and take a few were middle income I guess or is considered the new low income.

my mom got this letter too and it is actually very upsetting. she got charged for some internet payment service on her credit card three times! she called the credit card company and they asked her if she made the charge…my mom doesn’t even know how to use the internet. 2 years of free credit report just will not do…who knows what else they are taking from her. class action suit? let’s do it!

Here’s a question for everyone - if this crime was discovered sometime in July and Bank of America purchased Countrywide July 1st while Rebollo was perhaps still an active employee, would that hold Bank of America responsible for damages as well as Countrywide??? We are suffering terribly from the mortgage like many of you to the point of having to declare bankruptcy and now facing possible foreclosure. On our own we could not get the liars to restructure our mortgage so we contacted an organization called Neighborhood Assistance Corporation of America which you can find at NACA.com. If they can’t help you in your fight to keep your home, then nobody can. Everyone wants answers including us, but don’t think we’ll know the “whole story” until this investigation is completed. At that point hopefully the victims will get more information and know what path to take to protect themselves.
I got the letter too. v. mad. Just read this article in the L.A. Times about the mess. See the last paragraph about a suit filed against Countrywide. Says the suit requests that it be class action. I emailed the reporter. Will let you know if I learn anything more.

I have read all the posts on here and see that we are not the only ones just being told. We just received our letter today in the mail. This is unreal and hard to swallow. They expect us to understand the situation and accept their apolgy as nothing happened. No Way! They should be held accountable and I also think that Bank of America should be too! They bought them out and were aware of what was going on but said nothing. We will begin checking our credit reports and lord only knows if anything has happened or not. My husband has been out of work for 6 mnths and kept being turned down for jobs he was more than experienced for. Now we wonder if this has anything to do with it. Countrywide has not been willing to work with us through this hardship time and now we could be forced into bankruptcy! But they want us to understand this mishap…how is this right?
Please let me know if anyone has advice as to what we can do to get these irresponsible people that we trusted!

Countrywide has already financially ruined me. I thought it couldn’t get any worse, and the letter came. Guess I’ll move into a cave. I hope they go under and lose everything.

Yes Countrywide has lied mislead us and now sold our personal information…. Im going to try to contact attorneys to see if i can sue or we can get a class action lawsuite going.

My husband and I also received a letter from Countrywide. I hired a credit Co to check our credit. I have had to close three credit cards in the last 3 months due to fraud or identy theft. One was 4000.00 on May 5, 2009. I have never had this happen to me. I worked at a bank for 20 years and personal info is very confidential and should be maintained as so. Someone had got to be responsible for this unjust. And this someone is Countrywide Mtg. My husband was out of town and needed the use of his credit card, but was declined because of charges we did not make. This could go on for years,even with changing credit card numbers. If someone has your social security number it could go on for years.
My wife and I also receive a letter from countrywide.I’m very disappointed and angry at country countrywide for not being more responsible. what happens after two years who pays for the credit monitoring, and also what about the inconvenience and time to check my credit report and to wait longer when appling for a loan.
