An 11-year-old Georgia girl claims that an 8-year-old and two 9-year-old boys kidnapped and raped her, and the boys have been criminally charged. The most recent CNN story is Child-on-child rape case stuns small Georgia town. To watch the video of the girl describe the alleged attack, click here.
On one level, the girl sounds credible during the interview. On the other hand, several things seem very strange:
1) Though it’s barely detectible in the news reports, the alleged rape victim was not alone with the three boys–she was also with a friend of hers. So for the charge to be true, the three younger boys would have had to completely overpower two girls, one and probably both of whom are older.
2) The boy “rapist” was nine, his alleged victim was 11. In the video, the girl looks pretty big. (Note that in the picture above, she is standing to the right of her mother, and both of them are near the car. She’s almost as tall as the reporter who is interviewing her.)
The boy’s father says she is far bigger than his son. Could a boy rape a girl who is apparently much bigger than him? The father of the alleged rapist also claims that his son has a broken wrist.
3) Is an eight-or nine-year-old boy even physically capable of sex or rape?
There’s another problem with this case. I read this article and watched the videotape and almost fell off my chair. In the story, one of the boys’ fathers said that if there was sex between his son and the girl, it was consensual.
When asked for a response, incredibly, Police Chief Michael Wilkie of Acworth told CNN that because children that young cannot legally consent to sex, “we have to go with the charges we have”–in other words, the rape charges. So let’s say that the 11 year-old girl and a 9-year-old boy did have consensual sex. Because children cannot legally consent to sex, that means that the girl has been raped and the boy is a rapist? Even though they’re both children? Even though the girl is considerably older than the boy?

Follow-up comment rss or Leave a TrackbackTotally insane. Something needs to be done about false accusers in this country! Remember the Duke Case! Of course the boys didn’t do it, she’s vindictive or crazy. 1. She should have been able to outrun them.
2. She knows more about sex than they do.
3. They are not even producing sperm.
4. The police and prosecutor are nuts to believe her. I’ve lost
total faith in our justice system.
See? this is exactly why the lie that kids cannot consent is wrong–it necessarily leads to this type of absurdity, namely that the boys have to be charged but waitaminute the boys are children so the girl raped them too! but the kindly police conveniently use the absurdity one way only, the way it suits them, which is ONLY against the boys, even though they are in this case significantly younger and smaller than the girl. The police do this because they believe only males want sex and girls couldn’t possibly.
Wake up, people! don’t you see now clearly how these sex laws are just there to
oppress us even though they are sold to us “to protect the children.” yeah, right, those boys are done for if they end up in the juvenile system. I worked there: they will be constantly tortured and physically assaulted by truly violent kids and sadistic “staff”, and will be truly raped, as in real forcible anal rape, not this make believe “statutory” shit that the idiot police is charging them with. In fact, about 2/3 of the kids locked up where I worked were in for exactly the same idiotic “sex” charges as these little boys. I had to save one from suicide myself, and counsel another one for a brutal rape at the hands of a huge “kid” who the staff had to literally pry off him. WAKE UP, PEOPLE! these bastards aren’t protecting kids, they are destroying them, they are destroying our most human loving qualities!
The only way to solve this dilemma is to only call rape and sexual assault sexual attacks by force or coercion and only punish such, but sex that is wanted regardless of age by all involved is nobody’s business but that of the participants. In other words, we have to give up the lie that kids can’t consent, the very lie that caused this contradiction, and admit that they can, do and want to consent to sex.
It is the only way, otherwise we, including our kids, are just amusement for sadistic police and jailers. It amazes me that people have put up with this oppression for so long already–people have started revolutions over lesser despotism. The least we can do is change these antisexual laws ASAP.
OK - second try since my email was erased last time…
The blogger here raises some very important points - and I noted some of these in an email to the reporters covering this story for the Atlanta Journal yesterday morning.
This case reminds me in some ways of the infamous Ryan Harris case in Chicago more than a decade ago. Two seven year old boys were accused of the rape and murder of an 11 year old girl, and the police even obtained “confessions” from the youngsters. There was a general hue and cry about the state of juvenile predators in America and the weakness of our juvenile laws to deal with these small beasts.
Then suddenly, people began to ask the operative questions - long after the mainstream media had its fill of brutally abusing these children. It turned out that children that young could not even produce sperm, and they certainly lacked the ability to achieve sexual gratification. Then someone wondered how it was that two tiny little boys had the physical strength to grab a coordinated 11 year old girl and drag her off in daylight.
As it turned out, Ryan Harris was murdered by a serial rapist. The little boys, who had spent time locked up and shackled, were completely innocent. They had been forced to confess through coercive interrogation techniques designed to obtain confessions from adults. Although both of the boys obtained huge settlements from the city, at least one has gone on to suffer permanent emotional damage and is now imprisoned.
Imagine being charged with RAPE at age 8, when you don’t even exactly know where babies come from. Imagine being arrested, taken from your home, dragged to a youth prison facility, all because some much bigger and older girl claims that you threatened her with a rock and touched her privates. Imagine that you are fingerprinted and photographed just like an adult prisoner, subject to a strip search, deloused, and placed in prison clothes. Then imagine that you are in constant danger from older and bigger inmates who might find you a tasty tidbit indeed. Next imagine that you are dragged into a Sheriff’s car and then off to court - in full view of all sorts of strangers, while you are wearing a jail uniform and shackled like an animal - despite the fact that you could cause harm to no one. Then imagine that you are placed in a chair in a huge room, where no one believes what you have to say, and your parents are upset and your Mom crying, and everyone says mean things about you. Then, for good measure, after being shackled for hours, you are taken back to jail, with no hope and no understanding of your circumstances, other than that the adults around you are brutally abusing you.
Let’s consider for a moment that the allegations against the boys are true. America is the only country in the world that allows children less than 10 to be held criminally responsible for their actions, based on a biblical theory that seven is the age of reason. All other countries set 10 as the bar, and some even set 12 or 14 as the bar, because they understand that very young children - especially those less than 10 - lack an understanding of the nature and consequences of their actions. These children lack the ability to form criminal intent. Yet they are treated as though they are criminals in every sense of the word. Worse - it is very unlikely that these inarticulate little beings will be able to properly assist in their defense, or even understand the events occuring around them.
It is ironic that these boys would have been better protected under common law instead of the juvenile system. Until the juvenile system, it was universally agreed that boys less than 14 could not legally commit the crime of rape. This was at a time when boys 14 often worked outside the home or married at that age. Also, under common law, children between seven and 14 are protected by the rebuttable presumption of incapacity - the prosecutor must show that the child recognized and understood the nature and consequences of his actions. Unfortunately for these boys, they are protected by the juvenile court system - which turns every act of sexual experimentation by children into a sex crime.
But let’s ask some questions about the alleged victim and the crime - let’s not take what she said for granted. She is 11 and the oldest boy is barely 9. The boys have been described as very small in stature, and the girl appears to be at least 5′0″ and physically coordinated. She has the presence of mind to give media interviews in parking lots and articulate her thinking. She appears unafraid of discussing the events - so why exactly did she wait so long to make her claim?
Little 8 and 9 year old boys are rather inarticulate creatures compared with 11 year old girls - and they are rather uncoordinated compared to the opposite sex. I say this as a former 11 year old girl myself. We were generally bigger and stronger. And - we never played with boys that age. If an 8 year old boy had tried to grab me at that age or threatened me with a rock or rope, I would have kicked him, shoved him, scratched, him, and made him suffer. Girls are very adept at kicking, scratching and biting. I cannot imagine being outsmarted by an 8 or 9 year old boy when I was in the fifth grade. The difference in intellectual development and understanding at that age is phenomenal.
These boys likely are living in a state of confusion and terror. That’s good for the state - it will be easy to extract confessions - false or otherwise. In fact, every day that they are kept from their parents, they are in serious danger of making ill conceived statements that may implicate themselves. They will be encouraged to speak freely with counselors and mental health professionals - all of whom are salivating at the possibility of treating the youngest rapist ever - and perhaps becoming famous or a media star like the local - previously unknown, chief of police. False confessions, just like in the Ryan Harris case - are a huge possibility here if those boys are not released immediately.
The sad part of this story is that it may very well be the girls who are guilty of the crime, if indeed any crime has been committed. If 11 year old girls knowingly participated in sexual acts with 8 year olds, they are outside of the permitted age range for nonconsensual activity - the so called Romeo and Juliet provision. The Chief of Police has allowed himself to be sucked in to the stereoptype that only boys commit rape or sexual assault. When an 11 year old girl does this sort of thing with younger boys - unless she truly is somehow forced, she is really acting inappropriately. I don’t really think it is a crime - but it is inappropriate sexual experimentation and she needs to understand boundaries.
I’ll say it right here - I have little or no doubt that this is a fake rape case, brought on by hysteria and media hype. Those boys already have been damaged, and unfortunately, their parents lack the means and financial ability to properly fight or even understand the charges. The lawyers here certainly should have been able to get the boys released to their parents. There is no reason in the world to hold the boys in jail at this stage and it only helps the prosecution and damages the defense.
BTW - I totally disagree with the person above who says consent at any age. Adult pedophiles are monsters and should never be given a free ride. I am hoping that the writer was really talking about sexual acts between children and not children and adults - free love societies that advocate consensual relationships between adults and children are gross, disgusting and should not be tolerated in a civilized society.
